The Deputy Counsel is as senior level attorney and advisor who reports directly to the Director of the Authorities Budget Office (ABO). In this role the Deputy Counsel is responsible for supervising the ABO’s legal department and providing legal advice to the Director and senior team on litigation, legislation and policy. The Deputy Counsel is an expert in New York state laws that apply to the vast range of public authorities, particularly the Public Authorities Law, General Municipal Law, Public Officers Law, Not for Profit Corporations Law, Civil Practice Law and Rules, and State Administrative Procedure Act.
The Deputy Counsel is responsible for overseeing all of the agency’s legal activities, including complex litigation and legislation. They will work collaboratively with the Attorney General and prepare legal cases for which there is little precedent, and which have a major impact on the ABO’s mission and program. The Deputy Counsel is responsible for the preparation of memoranda, subpoenas, briefs and other material, analyzing legal issues and providing legal opinions at the request of the Director. The Deputy Counsel is capable of working closely with the Compliance department to answer novel legal questions that may arise during an audit.
The Deputy Counsel will provide legal advice and external representation to the ABO during investigations and confer with outside parties on legal action to mediate, negotiate or settle issues related to the ABO’s mission and programs. The Deputy Counsel will specifically be expected to:
• Supervise lower-level attorneys and policy staff and review and approve completed work.
• Supervise and review the preparation of a wide variety of legal documents, including briefs and subpoenas.
• Direct training of staff, including developing and implementing general legal training programs and programs specific to the needs of the agency legal program.
• Draft, review and approve rules and regulations proposed by agency staff; ensure that the regulations conform to the requirements of the State Administrative Procedure Act.
• Review and monitor the handling of hearings by agency staff and review decisions of hearings.
• Prepare and supervise the preparation of proposed legislation and , supporting memoranda; evaluates bills introduced in the legislature for the impact on the ABO and public authority operations and programs.
• Reviews proposed and enacted laws and rules of public authorities to ensure their compliance with state and federal laws, rules, and regulations.
• Provides counsel and advice to the Director and the senior team about complex legal matters and the interpretation and implementation of state and federal legislation and court decisions, memoranda of understanding, and other negotiated agreements.
• Evaluate and approve legal interpretations, advisory opinions, forms, policy memoranda, and other documents prepared by staff.
• Drafts and revises the most complex, sensitive, or novel legislation, regulations, legal interpretation, advisory opinions, and other documents about public authorities.
• Develops and approves legal strategies for sensitive cases and matters for the ABO.
• May represent the agency in legal proceedings or with the Office of the Attorney General; advise agency staff and representatives from other state and local agencies and authorities about legal matters.
• Prepares legal actions to enforce laws, rules, regulations, and rulings; and may serve as the agency’s ethics or FOIL appeals officer.
• Works closely with the Director and the Attorney General’s Office on lawsuits including the ABO.
• Provides advice to the ABO related to data and privacy issues.

MINIMUM QUALIFICATIONS:
Must hold a law degree from an accredited law school; admission to, and member in good standing of, the New York State Bar; and seven years of relevant post-bar experience.
PREFERRED QUALIFICATIONS:
• Litigation and appeals experience in the public sector.
• Experience and proven expertise related to Public Authorities.
• 15 or more years’ experience navigating the legal landscape within governmental agencies and authorities.

For new State employees appointed to graded positions, the annual salary is the hiring rate (beginning of the Salary Range) of the position. Promotion salaries are calculated by the NYS Office of the State Comptroller in accordance with NYS Civil Service Law, OSC Payroll rules and regulations and negotiated union contracts.
