Position Overview: 

We have an exciting temporary opportunity to work at the forefront of brand innovation, consumer engagement, and risk management. You’ll help shape the legal guardrails around innovative marketing strategies while protecting the integrity of our brand and customer experience. Reporting to our Senior Director, IP & Marketing Counsel, our Junior IP & Marketing Counsel role will focus on mitigating risk and providing legal guidance related to marketing, advertising, intellectual property, data privacy, and omnichannel commerce, with a strong emphasis on social media, influencer programs, and consumer engagement initiatives. 

The ideal candidate has a strong foundation in advertising and IP law, and familiarity with data protection practices, particularly in the context of e-commerce and digital marketing. 

Responsibilities 

Marketing & IP: 

  • Provide legal support for intellectual property matters, including trademarks, copyrights, and brand protection efforts. 

  • Partner cross-functionally and provide legal support as a key legal advisor on all marketing, promotional and advertising initiatives.  

  • Review, draft, and negotiate a variety of commercial agreements related to marketing campaigns, influencer partnerships, sponsorships, and talent/ambassador programs. 

  • Advise on advertising, claim substantiation, and promotional activities to ensure compliance with FTC, NAD, CCV and state advertising laws. 

  • Provide legal guidance for social media initiatives, user-generated content, and branded content development. 

  • Review social media content and other consumer-facing marketing to ensure compliance 

  • Oversee brand usage and collaborate with IP counsel on trademark and copyright clearance, enforcement, and licensing matters. 

  • Perform advanced legal review of projects, campaigns, and designs, and advise on legal requirements and risk assessment. 

  • Work closely with cross-functional teams and production vendors to ensure appropriate releases, rights, and protections are in place in advance of photoshoots and campaigns.

  • Assist the marketing team with creating T&Cs for sweepstakes and giveaways. 

  • Assist with the Company’s presence at pop-ups, marketplaces, and sponsored activities/events regarding legal and insurance protections, including contract review and advice regarding the same, cross-functionally. 

  • Strategically educate the Marketing team on legal and risk parameters.  

  • Collaborate with the support team and various departments to collect evidence, specimens, and other materials for global trademark filings and enforcement. 

  • Support the company’s copyright registration master list, consisting of over 300 registrations. 

  • Provide support to IP Counsel where needed on various intellectual property prosecution, maintenance, and enforcement matters, including drafting and sending cease and desist letters.  

  • Work closely with social media and brand marketing teams to support campaigns across platforms, including Instagram, TikTok, Instagram, YouTube, Facebook, X, LinkedIn, and emerging channels. Ensure that influencer partnerships, endorsements, and user-generated content align with disclosure obligations and company guidelines. Offer real-time feedback on copy and visual content to maintain compliant messaging while preserving brand voice.  

  • Assist in developing scalable policies, training, and toolkits for social media compliance, helping teams move quickly without compromising regulatory requirements. 

Privacy & Data Protection: 

  • Advise cross-functional teams on consumer data privacy practices in marketing, e-commerce, and digital engagement strategies. 

  • Partner with Information Security, eCommerce, and Marketing teams to evaluate legal risk related to data collection, targeting, analytics, and personalization. 

  • Partner with team members to ensure advertising to consumers, including with new technologies, meets legal requirements. 

General Legal Advisory: 

  • Stay informed on evolving legal and regulatory developments in advertising, privacy, IP, and digital commerce. 

  • Educate internal teams through training and guidance materials on legal best practices. 

  • Conduct legal research and prepare internal guidance or risk assessments on relevant regulations, especially those affecting the retail and consumer goods space. 

  • Collaborate closely with Legal, Compliance, and external counsel as needed to manage risk and implement scalable processes 

  • Respond to incoming requests for legal advice/business guidance from cross-functional partners and exercising judgement in prioritizing requests.  

  • Responsible for drafting, reviewing and editing commercial agreements, including:  non-disclosure agreements, marketing, retail, consulting agreements, statements of work, event agreements, sponsorship agreements, product collaboration agreements, intellectual property releases, and influencer agreements; amendments; addendums; termination letters; and various other contracts.  

  • Educate cross-functional teams on the internal legal review process, including contract review and negotiation process.  

  • Support claims and litigation matters  

  • Manage special projects as needed related to any subject area impacting fashion/retail, providing research, reporting, advice and such other tasks as required in support of such projects.  

  • Consult with management, outside counsel, advisors, and cross functional teams as necessary. 

  • Create legal education materials for, and explain complex legal concepts to, cross-functional partners. 

 

 

Our Ideal Candidate Will Have: 

  • J.D. from an accredited law school and active bar membership in good standing 

  • 2-4 years’ experience as counsel at a law firm and/or In-house experience supporting consumer-facing brands, especially in retail, beauty, tech, or media. 

  • Practical experience with marketing law, intellectual property, digital media, and privacy issues 

  • Knowledge of eCommerce platforms, analytics tools, and marketing technology is a plus 

  • Familiarity with privacy and consumer data laws, particularly in the context of marketing and omnichannel commerce. 

  • Strong legal drafting, contract negotiation, and issue-spotting skills. 

  • Ability to balance legal risk with business objectives in a fast-moving environment. 

  • Excellent interpersonal and communication skills, with the ability to build strong working relationships across teams. 

  • A high level of accountability, reliability and initiative 

  • Possess a high level of discretion, tact, judgment and ability to maintain confidentiality  

  • Ability to communicate complex issues, risks and opportunities in an easily understood and concise manner  

  • A strong ability to build cross-functional partnerships and work collaboratively
