Position Reports To: CEO/Co-Founder
Position to remain posted until at least March 28, 2025
Purpose of Position: Focus on protecting our brand assets, managing trademark portfolios, and handling commercial contracts.
Essential Duties and Responsibilities:
- Strong foundation in intellectual property and contract law, with a keen interest in the evolving legal landscape of the hydroponics industry.
- Monitors and analyzes issues in various phases of government regulatory procedures to identify trends important to the organization for use by management in decision making.
- Provides analysis and background material in responses to regulations, policies, and legislation.
- Participate in the development of organizational strategy to address regulatory affairs.
- Reviews and edits materials to meet regulatory requirements and organization policy.
- Develops and prepares data required for submission to regulatory bodies.
- Interfaces with key staff members in the Product Development, Operations, Legal, and Customer Service Departments to meet scheduled submission dates.
- Communicate with representatives of Federal and State agencies and other outside organizations on issues related to the organization.
- Establishes and maintains relationships with appropriate organizations in the private sector to obtain information on subject areas of interest and attends selected meetings on relevant topics.
- Advises on the organization's position on proposals and assists in implementing the internal communications program regarding government legislation that affects the organization's operations.
- Support set up of contract management software to store/monitor all agreements for centralized management, process improvement, and tracking of renewals.
- Monitors proposed legislation and regulations for possible impact and effect on the organization.
- Advises department manager when significant deviations occur from planned submission schedule or when product, testing, labeling, or service will be unlikely to meet regulatory requirements.
- May meet with government officials and other external parties to resolve grievances and/or advance positions.
- Assists in filing, monitoring, and enforcing trademarks domestically and internationally.
- Draft, review, and negotiate agreements, including supplier contracts, licensing agreements, and partnership deals.
- Ensuring marketing and branding initiatives comply with IP laws and industry regulations.
- Identify and address potential trademarks and contract risks to protect company interests.
- Provides research and assistance in trademark disputes and contract enforcement matters.
- Work with marketing, product development, and sales teams to safeguard brand integrity and contractual obligations.
- Other duties as assigned.
- J.D. from an accredited law school; licensed to practice in Colorado and California highly preferred
- 2+ years of experience in trademark law and/or contract law
- Familiarity with USPTO trademark processes and enforcement strategies
- Strong contract drafting and negotiation skills
- Excellent legal research, analytical, and communication abilities
- Ability to manage multiple projects in a fast-paced environment
- Experience in the retail, agriculture, or hydroponics industry
- Knowledge of international trademark laws and regulations
- Familiarity with regulatory issues affecting hydroponic products

Compensation includes a salary commensurate with experience, participation in group insurance plans upon eligibility, paid time off, sick leave, parental leave and more. Individual compensation packages are based on various factors unique to each candidate, including skill set, experience, qualifications, and other job-related reasons. Part-time employees are eligible for up to six (6) days of paid sick leave (subject to state and local laws), two (2) weeks of paid parental leave, and participation in the 401k. Employees that move from part-time to full-time status may receive less than ten (10) PTO days based on their anniversary date. Benefits may be subject to generally applicable eligibility, waiting period, contribution, and other requirements and conditions.
