Main responsibilities:

The Senior Privacy and HIPAA Counsel plays a key role within Albertsons’ privacy team. This position leads legal support related to privacy compliance, retail pharmacy operations, and consumer-facing health initiatives. This role will focus on ensuring compliance with HIPAA, state privacy laws, and other applicable U.S. privacy regulations, while enabling innovation in patient and consumer engagement. 

This position can be based in Pleasanton, CA or Boise, ID.

  • Provide expert legal counsel on HIPAA Privacy and Security Rules, including Business Associate Agreements (BAAs), data aggregation, de-identification, and breach notification requirements.
  • Advise on state consumer privacy laws (e.g., CCPA/CPRA, Virginia CDPA, etc.) and federal regulations impacting health data.
  • Support product development and marketing initiatives with Privacy by Design principles, ensuring compliance in digital health platforms, mobile apps, and retail pharmacy services.
  • Draft, review, and negotiate privacy-related provisions in contracts with vendors, partners, service providers, and business associates.
  • Collaborate with cross-functional teams including Pharmacy, Product, Marketing, IT, Compliance, and Security to assess privacy risks and implement mitigation strategies.
  • Lead privacy incident response efforts, including investigation, legal analysis, and regulatory reporting.
  • Monitor and interpret evolving privacy laws, regulations, and enforcement trends, providing proactive guidance to stakeholders.
  • Participate in internal governance committees and contribute to the strategic direction of the enterprise privacy program.
  • Mentor legal and privacy professionals and contribute to training initiatives across the organization.

We are looking for candidates who possess the following:

  • Juris Doctor (JD) from an accredited law school; licensed to practice in at least one U.S. jurisdiction.
  • Minimum 8 years of legal experience, with at least 5 years focused on HIPAA and healthcare privacy.
  • Deep understanding of U.S. privacy laws, including HIPAA, FTC Act, and state-level consumer privacy regulations.
  • Experience supporting retail pharmacy, digital health, or consumer health products is strongly preferred.
  • Strong contract drafting and negotiation skills, especially in privacy and data protection contexts.
  • Ability to work independently and collaboratively in a fast-paced, matrixed environment.
  • Professional certifications (e.g., CIPP/US, CIPM, CHPC) are a plus.

The salary range is $177,000 to $248,000 annually. Starting salary will vary based on criteria such as location, experience, and qualifications. There may be flexibility for exceptional candidates.
