Position Overview:
Provides a wide array of legal services and the provision of opinions, advice, and assistance with general agency matters, as well as overseeing legal compliance in procurement and general contracting, managing the agency’s Freedom of Information Act (FOIA) responses, as well as other matters. Serves as legal counsel to the members of the Commission as well as the administrative, operational, investment and other staff and coordinates with staff, external counsel, the Attorney General’s office, and other third parties as appropriate.
Job Responsibilities:- Draft, negotiate, review and approve service provider contracts for legal sufficiency (e.g. procurement contracts and IT licensing agreements); explain legal implications of service provider contracts; assist with Requests for Proposals; and ensure proper compliance with the South Carolina Procurement Code as applicable.
- Oversee and assist with preparation and/or review of responses to records requests (including FOIA requests) and ensure compliance with RSIC policy and applicable law.
- Assist with assigned Commission sub-committees and provide opinions, advice and counsel to the CLO/CEO and Commissioners regarding statutory interpretation issues, Commission policies, legislation and legal implications of contracts and other documents. Maintain official minutes of all meetings.
- Develop relationships and oversee communication with the Attorney General’s office and management of required notices of retention of counsel.
- Assist with other contractual matters as needed under supervision of CLO and/or Senior Legal Investment Officer.
- Assist with various operational matters, including coordinating with the custodial bank in managing required tax forms for international and domestic tax matters.
- Perform other duties as assigned.
- Minimum and Additional Requirements
Acceptable:
- Juris Doctorate degree from an accredited law school
- Active member in good standing with the State Bar of South Carolina. Minimum of two (2) years of experience in a law firm, in-house counsel, or state agency.
- Experience in managing negotiation of complex contracts
- Experience in SC FOIA and/or procurement matters
- Legal writing, reasoning, and analysis
- Legal research skills, including use of online tools
- Strong organizational skills
- Teamwork and communication skills
- Ability to exercise sound judgement, tact and confidentiality
- Preferred Qualifications
Preferred:
- General knowledge of investments (stocks, bonds, private equity, real estate, hedge funds)
- Prior work with a public pension fund, South Carolina public entity, other government agency or institutional investor
