Founders Federal Credit Union is looking for a driven Attorney with a background in lending policies and procedures located on-site at our Corporate Headquarters in Lancaster, SC. Responsibilities and Duties:
The Attorney I is primarily responsible for serving as a trusted advocate to the Credit Union and representing its interest at all times. Will work closely with the SVP-Legal and VP– Litigation to advise Credit Union personnel on legal issues and appear in North Carolina courts on behalf of the Credit Union to protect its interests.
- Interpret laws and regulations to provide legal guidance to all departments of the Credit Union when necessary.
- Collaborate with the VP–Litigation on preparation of cases for collection efforts initiated by Share Recovery and Loss Control.
- Appear independently in North Carolina courts of proper jurisdiction on behalf of the credit union and represent its interests at all times which may include but not limited to magistrate’s court, probate court, and Court of Common Pleas.
- File all necessary pleadings with North Carolina courts to obtain judgements.
- Negotiate with third party counsel to resolve issues relating to collection efforts or probate issues as they may arise.
- Support the SVP-Legal in assessment of risk factors of proposed business decisions to effectively present Management with options to limit the Credit Union’s exposure.
- Remain up to date on pending legislation and regulatory changes which may affect the Credit Union’s business practices or planned initiatives.
- Communicate and strategize with external counsel in the event of potential litigation involving regulatory compliance issues.
- Develop an extensive knowledge of lending guidelines, FFCU Loan Policy and Loan Procedures, FFCU account openings and maintenance, and federal regulations and laws, including but not limited to ECOA, Fair Housing Act, Truth in Lending, HMDA, RESPA, and BSA.
- Comply with Founders’ policies and procedures, as well applicable laws, regulations, and statutes issued by federal agencies such as NCUA and FFIEC, including, but not limited to, GLB and BSA. Employees have legal and regulatory obligations to respect and protect the privacy of information and its integrity and confidentiality.
Job Specifications:
The individual must be licensed to practice law in North Carolina with 3-5 years of experience in creditor’s rights litigation. They must also possess the ability to produce work in an effective and efficient manner, with well-developed verbal and written communication skills as well as excellent analytical and judgment skills. They must develop a solid working knowledge of the requirements of lending policies and procedures, and federal laws and regulations. They must possess the ability to work independently with minimal supervision and must be adept at working effectively with people at all organizational levels. In this position, the employee must have a high level of integrity, a strong adherence to confidentiality of Credit Union data and work ethics. The Attorney I must be proficient in all Microsoft Office products.
