The Louisiana Department of Revenue (LDR) is responsible for fairly and efficiently collecting state tax revenues to fund public services, to regulate charitable gaming and the sale of alcoholic beverage and tobacco, and to support state agencies in the collection of overdue debts. Collectively, each program, unit, division and group work together to provide the core services to taxpayers of the State of Louisiana and stakeholders of the agency. LDR is comprised of the following groups: Tax Collection, Charitable Gaming, Alcohol and Tobacco Control (ATC), Debt Recovery and Louisiana Tax Free Shopping Commission.
 
The Office of Alcohol & Tobacco Control (ATC) is responsible for overseeing the alcoholic and tobacco industries within the state. The office is comprised of four divisions: Administrative, Business, Legal and Enforcement.

The Legal Unit includes litigation, mediation, formal settlement negotiations, participation in administrative hearings, regulatory oversight and policy planning and advisement. Types of litigation may include, but are not limited to: appeals of administrative decisions, injunctive relief and declaratory judgments. In addition, legal counsel exercises general overview of the Tobacco licensing and regulatory functions conducted by the Business and Enforcement Divisions. 

Duties include, but are not limited to:
  • Litigates complex cases and drafts pleadings in trial court, appellate court, federal court, and federal bankruptcy court, assists outside counsel in preparing and representing the ATC in complex and important litigation such as precedent cases before trial and appellate courts and administrative tribunals by drafting pleadings, interviewing witnesses, writing legal memoranda and briefs, participates in depositions incidental to civil, criminal, and administrative proceedings.
  • Performs administrative duties related to case inventories and special projects including, but not limited to, case monitoring, issue tracking, timekeeping and statistical case value tracking.
  • Researches and prepares responses to inquiries from industry members.
  • Participates in the development and delivery of office-wide training on policy, procedure; law and evidentiary matters.
  • Works on special projects as assigned by the ATC Commissioner or Deputy Assistant Secretary, serves as a backup to other attorney staff as needed.

This position will be domiciled in East Baton Rouge Parish. Applicants must select this parish on their application to indicate that they are available to work in the parish of this vacancy.

A Tax and Natural Disaster Clearance will be conducted on all selected applicants to validate the timely submission of tax returns and payments. It is a requirement that all Revenue employees must adhere to all tax laws of the State of Louisiana.

Minimum Qualifications

MINIMUM QUALIFICATIONS:
Possession of a license to practice law in the state of Louisiana.

To assist an attorney of higher rank in the preparation of court cases and/or advisory opinions and may litigate and/or prepare advisory opinions in cases of a routine nature.

Entry.

General from a higher ranking attorney, administrative law judge, or other agency administrator/executive.

Supervision Exercised:
None.

Location of Work:
May be used in all agencies.

Job Distinctions:
Differs from Attorney 2 by the level of supervision received and the level of expertise required in the preparation of legal opinions/courts cases assigned or hearings conducted.

Examples of Work

ATTORNEY:
Litigates routine cases in trial and appellate courts and before administrative tribunals under the supervision of a higher ranking attorney.

Assists an attorney of higher rank in preparing major or complex cases for trial by drafting pleadings, interviewing witnesses, writing legal memoranda and briefs.

Enters claims for collecting monies due the state.

Assists in preparing proposed legislation.

Drafts tentative rules and regulations and reviews rules, regulations, and bulletins prepared by administrative officers for conformity to the law.

Investigates reports of violations of statutes and administrative rules and regulations.

Prepares advisory opinions for review by a higher ranking attorney.

Prepares or reviews legal documents, including contracts, licenses, deeds, and abstracts.

Researches laws applicable to the above activities.

To conduct hearings and to render decisions.

ATTORNEY--ADMINISTRATIVE LAW JUDGES/REFEREES:
Convenes hearings that are of a routine nature; issues subpoenas; administers oaths; hears testimony; considers evidence; examines witnesses; maintains order; rules on motions, objections, admissibility of evidence and procedure; prepares and issues decisions and orders based upon all evidence gathered, research of pertinent statutes, pertinent jurisprudence, and independent assessment of acts based on credibility of witnesses and evidence.

Conducts pre-trial conferences with the attorneys to resolve preliminary issues and narrow the scope of the hearing to the facts actually in dispute.

Determines if there are jurisdictional or procedural issues to be disposed of and if so, decides the most appropriate manner (i.e. a limited hearing, an order to brief the issue, an order to amend the pleadings, a status conference, etc.) to address these issues.

Secures, compiles, and maintains all records of adjudications. Ensures that accurate records are maintained in the proceedings that evidence is properly marked and included in the case record, and that audio recordings are accurately marked and properly indexed and stores.

Conducts a continuous study of the current statues, regulations and case law related to areas of law for which hearings are assigned.
