Job Summary:
The Associate General Counsel, Litigation & Commercial Support will serve as support to the Chief Legal Officer and to the company’s leadership team. This role will oversee the company’s commercial transactions and litigation. Labor & employment experience and consumer regulatory compliance in the solar industry, home improvement industries, or other B2C industries is a plus. This role is essential for guiding a solar company through the intricate legal landscape of the renewable energy sector, ensuring operational success, and fostering sustainable business growth.
Key Responsibilities:
Business Program Support and Contract Management:
- Oversee the negotiation, drafting, and execution of contracts with suppliers, customers, and other stakeholders related to residential solar energy projects.
- Manage risk by advising on the structure of business development projects and forming business program agreements.
Litigation and Dispute Resolution:
- Oversee and manage litigation matters, disputes, and claims involving the company, working with external counsel when necessary.
- Develop strategies for dispute resolution, including negotiation, mediation, or settlement.
Risk Management:
- Identify and mitigate legal risks associated with the company’s operations and projects.
- Develop internal policies and procedures to protect the company from legal and financial exposure.
Stakeholder Engagement:
- Act as the primary liaison between the company and its external legal advisors, investors, and regulatory bodies.
- Represent the company in industry forums and regulatory proceedings.
Qualifications:
Education: Juris Doctor (JD) from an accredited law school. Admittance to the State Bar of Utah.
Experience: Minimum of 7+ years of litigation experience, with a preference for experience in the residential solar industry, home improvement industries, or other B2C industries.
- Proven track record in negotiating complex contracts and supporting business programs.
- Experience working with government agencies, industry regulators, and compliance frameworks related to the solar and renewable energy sectors.
- Labor & employment law experience is a plus.
Skills:
- Ability to manage a litigation and regulatory docket.
- In-depth understanding of solar energy market dynamics, federal and state regulations, and the energy industry’s legal environment.
- Strong leadership and management skills, with experience leading and mentoring legal teams.
- Excellent negotiation, drafting, and communication skills.
- Strong business acumen, able to advise on strategic decisions from a legal perspective.
Preferred Qualifications:
- Experience working in a high-growth solar energy or renewable energy company.
- Knowledge of home improvement sales and installation regulations, particularly in markets where the company operates or plans to expand.
- Familiarity with tax incentives, government subsidies, and policy-related issues affecting solar energy.
- High ethical standards and integrity, with a strong focus on compliance and corporate responsibility.
- Ability to balance legal risks with business objectives, providing sound advice in a fast-paced, evolving industry.
- Proactive, solution-oriented, and able to navigate complex legal challenges.
While performing the duties of this job, the employee is regularly required to talk or hear. Regular periods of sitting or standing may be required by this position. In addition, this position requires the ability to occasionally lift office products and supplies, up to 50 pounds. Specific vision abilities required by this job include close vision and the ability to adjust focus.
