Overview

Corporate Counsel, Litigation

 

The Litigation Department's extra-contractual and bad faith unit serves as internal counsel to AmTrust’s U.S. based, specialty, core, property, and workers' compensation claims organizations.

As Associate Corporate Counsel, Litigation, you will provide coverage and bad faith analysis, strategic advice on settlement opportunities, and manage a nationwide pending of extra-contractual matters. This position involves consulting with claims examiners and managers on responses to time-sensitive settlement demands, partnering with other stakeholders on coverage, advising on overall claims resolution strategy, and responding to various allegations by insureds, claimants, regulators, and other insurance carriers. You will also perform legal research, assist with corporate discovery, and review and respond to certain regulatory complaints.

 

This position may be remote or reside in any AmTrust claims office (subject to space constraints), with occasional travel.

 

 

Responsibilities

Responsibilities:

  • Consult and assist the claims department in responding to time limit and policy limit demands
  • Manage a portfolio of national extra-contractual matters
  • Provide coverage analysis, including addressing bad faith and extra-contractual concerns
  • Conduct legal research and analysis, providing conclusions and recommendations for coverage issues and claims handling decisions relative to bad faith and extra-contractual exposure
  • Develop and analyze broad claims, underwriting, and litigation data to isolate areas of concern and improvement
  • Present complex issues succinctly to upper management in the Claim, Litigation, and Underwriting Departments
  • Give guidance on additional investigation required to resolve coverage and extra-contractual concerns
  • Communicate with Company stakeholders in Claims, Underwriting, Regulatory, Audit, Reinsurance Compliance, and Corporate Legal
  • Collaborate with outside counsel to formulate proactive litigation and pre-suit strategies, direct and manage case strategy and budget, review and approve pleadings and motion papers, assist with deposition preparation and custodian interviews, and assist with internal investigations relative to extra-contractual and bad faith matters
  • Assist with litigation holds and ESI collections
  • Assist with subpoenas and corporate data requests
Qualifications

Qualifications:

  • JD from an American Bar Association accredited law school
  • 7+ years of legal experience focusing on coverage and/or extra-contractual issues (in-house or law firm)
  • Understanding of national coverage and extra-contractual/bad faith law
  • Ability to track down information and navigate a large company with minimal guidance
  • Excellent oral and written communication skills
  • Basic Excel skills.
