Job Description

PUBLIC FIDUCIARY LEGAL SECRETARY - BISBEE 
CLASSIFIED: Position is subject to the provisions of the Merit System Rules pursuant to Arizona Law  
OPEN:  Friday, November 1, 2024
CLOSES: Position is open until filled with applications reviewed upon receipt and may close at anytime  
Anticipated salary:  $37,000 - $50,000 annually, dependent upon qualifications, plus a comprehensive benefits package to include membership in the Arizona State Retirement System

Under general supervision performs paraprofessional legal work of routine to considerable difficulty for the Public Fiduciary; performs related duties as required or assigned.

Essential Functions

(Illustrative Only)Answers and directs incoming calls; prepares drafts of legal correspondence; performs basic research of legal issues, primarily in probate law; prepares pleadings for new cases to include --but not limited to-- probates, guardianships and conservatorships and calendars all necessary deadlines; prepares and files pleadings, motions, orders, and other legal documents for existing cases; acts as liaison with the court, other departments and outside agencies on legal matters; tracks, manages and prioritizes numerous and varied deadlines for the Public Fiduciary and assigned attorney; responsible for handling creditors and final distributions in probate cases; maintains a tickler system for the filing of accountings and inventories; participates as team member during estate inventories as needed; prepares agenda and takes notes for case review meetings; assists with budgetary expense tracking; orders office supplies.

Minimum Qualifications

High School Diploma or equivalent; three (3) years of experience as a legal secretary; must possess and maintain a valid Arizona Driver’s License and the ability to be covered by county insurance.

An equivalent combination of education and/or experience from which comparable knowledge, skills and abilities have been achieved may be considered.  

PREFERENCE: Preference may be given to applicants who are bilingual in English and Spanish, in speaking, reading and writing.

Knowledge, Skills & Abilities

Considerable knowledge of:

  • probate law including adult guardianship, conservatorship and decedent estates; 
  • drafting correspondence and legal documents;
  • legal terminology and forms;
  • state, civil, and criminal law, judicial procedures and methods of legal research;
  • modern office practices, procedures, and equipment;
  • business English, spelling, punctuation, and grammatical usage.
Working knowledge of:
  • the rules of evidence;
  • terminology in guardianship, conservatorship and probate cases.
Considerable skill in:
  • the use of word/data processing equipment;
  • providing accurate summaries and producing accurate documents;
  • using general mathematical principles;
  • analyzing potential liability and exercising good judgment performing tasks assigned;
  • carrying out instructions furnished orally or in written forms;
  • communicate effectively, both verbally and in writing:
  • analyzing and interpreting legal documents;
  • interpreting statutory and regulatory requirements;
  • organizing and managing case files. 
Ability to:
  • achieve results and analyze information to produce sensible solutions;
  • perform accounting functions for the calculation of statement of fees;
  • plan work and work independently;
  • establish and maintain an effective working relationship with employees, other agencies and the public.
  • prepare and maintain accurate records;
  • formulate concise queries;
  • obtain certificate to serve as department Notary;
  • read, write and speak English.

WORK ENVIRONMENTWork is primarily performed under general supervision. Incumbent generally performs work in a typical office setting with appropriate climate controls. Visits to ward locations may include extended periods in homes or storage areas with varying sanitary conditions, unpredictable climate control and ventilation. Required to drive throughout the county on occasion and other locations within the state sporadically.

PHYSICAL REQUIREMENTS: Essential functions of this position require: lifting, manual dexterity, ability to communicate.

Sedentary to Medium work: Requirements are dependent on the tasks of the day and range from Sedentary, exerting up to 10 pounds of force only occasionally with sitting for extended periods of time, to Medium, exerting up to 50 pounds of force occasionally and/or up to 20 pounds of force frequently or constantly to lift, carry, push, pull or otherwise move objects, including the human body; involves sitting only occasionally, walking and standing are required regularly, incumbents may be required to kneel, crouch/squat, crawl, climb, stoop, turn/twist, balance, reach, or handle. 

Mental Application:  Utilizes memory for details and verbal instructions, requires emotional stability, critical thinking and adaptability; creative problem-solving skills are important.
