Small Business Lending is looking to add a Litigation Attorney to the team!

Essential Functions & Responsibilities: (other duties may be assigned as needed):

  • Oversee and manage outside counsel retained by Newtek Bank, NH6, and NSBF in connection with litigation, foreclosure, bankruptcy, and loan liquidation matters.
  • Direct litigation strategy and monitor legal proceedings involving commercial loans, secured transactions, creditor rights, collections, and servicing disputes.
  • Review and evaluate pleadings, motions, settlement agreements, litigation budgets, and legal invoices submitted by outside counsel.
  • Provide legal guidance and strategic recommendations regarding foreclosure actions, bankruptcy proceedings, receiverships, workouts, loan restructurings, and collateral recovery efforts.
  • Collaborate with internal servicing, credit, asset management, collections, and executive teams to develop and execute recovery and litigation strategies.
  • Analyze legal risks associated with loan enforcement actions and advise management on exposure, reserves, and resolution options.
  • Monitor compliance with federal, state, and local laws governing lending, servicing, foreclosure, bankruptcy, and debt recovery activities.
  • Coordinate responses to borrower disputes, litigation claims, subpoenas, and regulatory inquiries.
  • Assist in developing and implementing policies, procedures, and best practices related to litigation management and loan recovery operations.
  • Track litigation progress and provide regular status updates and reporting to senior management.
  • Support negotiations involving settlements, loan workouts, restructuring agreements, and contested matters.
  • Manage multiple legal matters simultaneously while ensuring timely and cost-effective resolution outcomes.

Knowledge, Skills & Abilities:

  • Active membership and good standing with at least one state bar association.
  • Minimum of four (4) years of legal experience in commercial litigation, foreclosure, bankruptcy, creditor rights, and commercial real estate matters.
  • Prior experience working for or representing a financial institution, bank, commercial lender, or specialty finance company strongly preferred.
  • Knowledge of commercial loan documentation, secured lending, UCC matters, foreclosure processes, bankruptcy law, and loan servicing litigation.
  • Experience managing and supervising outside counsel across multiple jurisdictions.
  • Strong understanding of litigation management, risk assessment, and recovery strategies involving distressed commercial assets.
  • Excellent negotiation, analytical, organizational, and problem-solving skills.
  • Ability to interpret complex legal and financial documents and provide practical business-oriented legal advice.
  • Strong written and verbal communication skills with the ability to effectively interact with executives, internal stakeholders, and external counsel.
  • Proficiency with legal research tools, litigation management systems, and Microsoft Office applications.
  • Ability to work in a fast-paced environment while managing competing priorities and deadlines.
  • Experience with SBA lending, commercial loan servicing, or special assets/workout groups is highly desirable.
  • Familiarity with banking regulations and regulatory compliance matters related to loan servicing and collections.
  • Demonstrated ability to manage complex litigation portfolios and achieve favorable recovery outcomes.
  • Strong business acumen and strategic decision-making capabilities.

Education & Certification Requirements:

Juris Doctor (J.D.) degree from an accredited law school.

Salary Range: $100,000 - $140,000 per year
