POSITION: Full-Time Staff Attorney

DEPARTMENT: Superior Courts 4, 5, and 7

STATUS: Full-time

FLSA STATUS: Exempt

Hourly Rate: $45.4197

Person would serve as full‑time Staff Attorney ("SA") for Superior Courts 4, 5, and 7 and be responsible for research and preparation of dispositive motions to be heard by the Courts. Further, SA is responsible for the generation of Orders from such hearings. In addition, the SA is responsible for sitting as Pro Tempore (“Pro Tem”) and Temporary Judge as needed.

DUTIES:

Perform legal research as requested by the Judges and in preparation for hearings on dispositive motions and trials. Review current legal decisions issued by the Indiana Supreme Court and/or the Indiana Court of Appeals.

Prepare memorandums for the Judges on all dispositive motions including summaries of all briefs filed, the current law, and/or any unanswered questions. In addition, provide a listing and summary of the pending motions to be heard by the Courts and/or pending motions that will be affected by the outcome of such hearings.

Provide support to the Judges in jury trial proceedings, including research/briefing on anticipated legal issues and legal issues that arise during trial, and preparation of preliminary and final jury instructions.

Provide the Judges with a summary of the case and legal proceedings in lengthy and/or complex cases.

Generate detailed Proposed Orders for the Judges’ approval; and, in addition, receive, organize and review proposed orders submitted to the Court by counsel.

Perform various clerical duties as needed and ensuring that appropriate case entries are made for cases.

Make phone calls to attorneys regarding objections, settings, clarification of pleadings filed, or other inquiries as directed by the Judges.

Conduct telephonic conferences with counsel for the purpose of scheduling hearing and trial dates and addressing case management issues.

Sit as Judge Pro Tem when requested by the regular Judges or sit as Temporary Judge when requested by the regular Judges.

Review case files for cases that will be heard by the SA as Judge Pro Tem or temporary Judge and prepare Orders after trials or hearings are completed.

Assist the Judges in reviewing motions made in the daily work.

Answer procedural questions from the public and attorneys carefully avoiding the dispensing of legal advice.

Such other duties as requested by the Judges.

REQUIRED KNOWLEDGE, SKILLS AND ABILITIES:

J.D. from an accredited law school and be a licensed Indiana attorney in good standing.

Knowledge and ability to research electronically and in books to find relevant cases and statutes and resources.

Working knowledge of PC computers, Microsoft office products including Word, Excel and Outlook and printers/scanners.

Ability to compose and type entries and Orders based on the pleadings in the cases file and/or proposed orders submitted by counsel.

Proficiency in writing, spelling, grammar, and punctuation.

Ability to communicate with other staff members, the Judges, attorneys, and the general public in a professional and courteous manner.

Ability to work independently and with limited supervision.

Ability to be flexible in job duties and cooperative with other staff members and Judge.

Experience/knowledge in/of jury trials, dispositive motions, and the following areas of law preferred:  adoption, guardianship, estates, trusts, felony criminal, family.
