THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO THE RECRUITMENT RANGE OF $92,917 to $115,937. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

This position is not subject to the Fair Labor Standards Act.

The salary grade for this position is LG09. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. The primary purpose of the Labor Section is to act as advisor and legal representative to the North Carolina Department of Labor (“NCDOL”). NCDOL’s mission is to foster a safe, healthy, fair and productive North Carolina.

This Attorney IV position is an excellent opportunity for an attorney who enjoys litigation, and wants to make a positive difference in North Carolina's workforce, and make a lasting impact on the everyday life of North Carolina citizens.

The Labor Section represents NCDOL in all civil actions and administrative proceedings including those involving the enforcement of: the Occupational Safety and Health Act of North Carolina; the North Carolina Wage and Hour Act; the Retaliatory Employment Discrimination Act; the Uniform Boiler and Pressure Vessels Act; the Elevator Safety Act; the Amusement Device Safety Act; the Passenger Tramway Safety Act; the Migrant Housing Act; other regulatory laws, and employment personnel actions.

The Labor Section practices before a variety of judicial forums including the Office of Administrative Hearings, the North Carolina Occupational Safety and Health Review Commission, State court, and Federal courts. The attorneys in this Section handle cases from the trial stage and through all appellate stages, in coordination with the Solicitor General’s Office.

Attorneys often handle complex, novel, and precedent-setting cases that impact the citizens of North Carolina.

This Attorney IV position is responsible for providing legal representation and advice to the NCDOL in matters involving the administration and enforcement of State labor laws including various regulatory programs that may involve constitutional issues, public policy concerns or issues that may impact economic conditions, human resources, or a wide segment of the general public. Areas of representation include, but are not limited to, enforcement of The Retaliatory Employment Discrimination Act, N.C.G.S. §95-240, et seq; the Occupational Safety and Health Act of North Carolina, N.C.G.S. §95-126, et seq; the North Carolina Wage and Hour Act, N.C.G.S. §95-25.1, et seq; the Uniform Boiler and Pressure Vessels Act, N.C.G.S.§95-69.8, et seq; the Elevator Safety Act, N.C.G.S. §95-110.1, et seq; the Amusement Device Safety Act, N.C.G.S. §95- 111.1 et seq; the Passenger Tramway Safety Act, N.C.G.S. §95-116 et seq; and the Migrant Housing Act, N.C.G.S. §95-222 et seq.

The Attorney IV is also responsible for defending the State and its officials as employers in other discrimination and employment law cases in both state and federal courts including, but not limited to, claims of discrimination pursuant to: the Civil Rights Act of 1991 (which significantly amends Title VII of the Civil Rights Act of 1964) (“Title VII”), which prohibits discrimination against employees on the basis of race, color, religion, sex or national origin; the Age Discrimination in Employment Act (“ADEA”), which prohibits discrimination against employees on the basis of age; and, the Americans With Disabilities Act (“ADA”), which prohibits discrimination against disabled individuals in critical areas such as employment and public services and accommodations.

This position requires the ability to analyze a case, and develop and execute an effective litigation strategy to achieve best possible outcome for the State of North Carolina.

This position frequently serves as lead attorney for cases that require the assignment of a litigation team, reviewing and approving the work product of any attorney who serves on the team.

The Section also frequently has interns, externs, or volunteers who require assistance and supervision of assigned tasks. This position serves as a mentor to those employees, assisting them with issue identification and development of litigation skills.

The Labor Section promotes teamwork and collaboration with internal and external partners to ensure that the best outcome is achieved for North Carolina.

The Labor Section is part of the Civil Division. The Civil Division is committed to providing opportunities for development through the sharing of expertise and knowledge across the six different sections of the Civil Division.

Criminal Appeals and Appellate Argument

This position researches and prepares appellate briefs on behalf of the state in criminal cases.

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and four years of progressively responsible professional legal experience.

Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing.
