SUMMARY:
The ERISA Attorney will serve in an integral role by ensuring compliance, providing guidance with regulatory agencies, along with the oversight for all legal compliance. Additional core areas of focus will include but not be limited to providing legal documents, contract review and client claims support, along with some M&A involvement for our growing company. The successful candidate will serve as the primary legal resource for executives and the management team.
JOB RESPONSIBILITIES:
- Provides prompt internal and external responses on all employee benefit-related matters, including ERISA, ACA, HIPAA, COBRA, Mental Health Parity and Addiction Equity Act, leave laws and other relevant federal and state insurance laws
- Drafts and reviews documents and amendments for legal matters, including those required for health insurance benefits
- Offers recommendations on negotiations and related strategies
- Researches and responds to benefit and legal compliance inquiries
- Conducts compliance reviews, as needed
- Presents employee benefits compliance webinars and training sessions, as needed, to enhance the understanding of relevant laws and regulations for internal associates and clients
- Supports and provides oversight for client claim activities, including insurance coverage review and analysis
- Collaborates with the Executive team on M&A activities, with some facilitation of the due diligence and integration processes
- Coordinates and manages outside attorney representation of the company in legal matters and proceedings
- Designs and oversees the company’s policies and positions on legal matters
- Reviews and provides direction on new business matters and contracts
- Prepares and files government reports and documents, as needed
- Analyzes legal matters and compliance, while offering guidance to management and associates
REQUIREMENTS:
- Juris Doctor Degree from an accredited law school
- 6-10 years of proven legal experience within a corporate environment
- Active license to practice law in the State of Illinois
- Knowledge of and experience working in the insurance industry - insurance regulatory and compliance experience required
- In-depth knowledge of ERISA, ACA, and other federal and state insurance legislation and regulation
- Strong interpersonal, presentation and writing skills
- Exceptional negotiating and problem solving skills
- Highly analytical with a keen attention to detail
- Maintains an expert status within the legal profession and stays abreast of law and regulatory requirements
- Provides in-person or virtual representation for the company as needed, which may include occasional travel

PHYSICAL DEMANDS:
The ability to sit at a desk for extended periods of time. Ability to lift and carry files, laptop, and other paperwork. Must be able to lift 10 lbs. The worker is required to have close visual acuity to perform an activity such as: preparing and analyzing data and figures; transcribing; viewing a computer terminal; extensive reading close to the eyes.
POSITION TYPE AND EXPECTED HOURS OF WORK:
This is a full- time, exempt position. This role must work 40.0 hours a week to maintain full time status. Standard business hours of work are Monday through Friday, 8:00 a.m. to 5 p.m. Due to the responsibility that a leadership role carries, this person may need to be available early in the morning and work into the evening or on weekends, as business needs require.
