Job Description

Under the administrative direction of the Chief Deputy Attorney General, and the administrative and legal direction of the Chief Assistant Attorney General (CAAG), Division of Medi-Cal Fraud and Elder Abuse (DMFEA), the Civil Senior Assistant Attorney General (SAAG) plans, organizes, and directs the work of the Civil Section within the DMFEA of the Department of Justice. The DMFEA serves as the state’s federally mandated Medicaid Fraud Control Unit (MFCU) and enforces statewide authority in such matters through civil and criminal prosecutions.

The Civil SAAG will oversee all state and federal civil actions for recovery attributable to fraud by Medi-Cal providers and suppliers and those engaged in the willful or intentional neglect or abuse of vulnerable or dependent adults. The Civil SAAG works closely and collaboratively with the head of the Program Integrity Unit (PIU) of the California Department of Health Care Services to coordinate investigations involving California Medicaid providers. The SAAG for the Civil Section will assist in setting policies and parameters in its division of responsibility with the PIU to ensure both adequate and consistent on-going case referrals for prosecution. Additionally, the Civil SAAG will oversee the effective integration of civil cases with the National Association of Medicaid Fraud Control Units' (NAMFCU) global team process with a view toward ensuring that California is aggressively represented in the leadership and composition of global teams. Furthermore, the Civil SAAG will assist the CAAG in the responsibility of meeting the federal Performance Standards in its funded mission under the oversight by the U.S. Office of Inspector General (“OIG”) for Health and Human Services and develop policies to ensure on-going compliance with all federal rules. The Civil SAAG ensures that civil Deputy Attorney Generals are trained in the most effective investigation of civil fraud cases, including False Claims Act (FCA) cases, as well as pre-trial and trial skills in federal and state court.

Flexible schedules and telecommuting options may be available. The position will be headquartered in DMFEA's San Diego Regional Office and will be expected to travel throughout California as required, as well as potentially travel out-of-state.

In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:

  1. Experience in the practice of Medi-Cal fraud civil investigation and prosecution and ability to analyze complex legal problems and apply legal principles and precedents.
  2. Demonstrated ability to direct civil legal work, including litigation, in various areas of Medi-Cal fraud and elder abuse for a large staff of attorneys and other technical personnel.
  3. Demonstrated ability to provide recommendations and legal advice to Executive management on policy development, and to direct the implementation of such policies in relation to Medi-Cal fraud and elder abuse.
  4. Strong communication and interpersonal skills with a demonstrated ability to interact with multi-disciplinary professionals, other state and federal agencies, and other members of the Department of Justice at all levels and maintain good relations with the public, the press, and various civic organizations.
  5. Demonstrated leadership ability, planning, and supervisory skills.
