Job Description

Job Summary:

The Collections Lawyer is responsible for managing legal aspects of debt recovery, representing clients in collection proceedings, and ensuring compliance with federal and state debt collection laws. This role involves litigation, negotiation, and enforcement of judgments to recover outstanding debts on behalf of creditors.

Key Responsibilities:

  • Assist the collections team in complying with and enforcing terms and customer contracts.
  • Advise clients on debt collection strategies, risks, and legal remedies.
  • Conduct legal research and ensure compliance with the Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), and applicable state laws.
  • Manage a caseload of collection files from inception to resolution, including post-judgment enforcement (e.g., garnishments, liens, asset recovery).
  • Write collection letters and communicate with debtors.
  • Coordinate with internal departments (finance, compliance, customer service) to gather necessary documentation and ensure smooth case handling.
  • Stay current on changes in laws affecting debt collection and legal practices.

Qualifications:

  • Juris Doctor (JD) from an accredited law school.
  • Active license to practice law in Texas; additional states preferred.
  • 3+ years of experience in collections law, civil litigation, or creditor rights.
  • Strong knowledge of debt collection laws, procedures, and litigation strategies.
  • Excellent written and verbal communication skills.
  • Strong organizational skills and ability to manage multiple cases.
  • Ability to work both independently and collaboratively.

Preferred Skills:

  • Well versed in UCC law and statutory liens.
  • Familiarity with bankruptcy and foreclosure proceedings.
