Job Description:

The Department of Health and Human Services (DHHS) team contributes to the lives and health of Nebraskans every day. At every level of our organization, our goal is to be honest, trustworthy, competent and loyal; our Legal Services team makes that possible with their expertise in ensuring policies, regulations and guidelines are being followed

Law clerks with DHHS serve across all divisions of the agency, including the divisions of Public Health, Child and Family Services, Developmental Disabilities, Behavioral Health, and Medicaid and Long-Term Care. As a result, law clerks with the department obtain experience in a diverse range of practice areas, including but not limited to the following areas of law: administrative, health care, employment, constitutional, public benefits, family, insurance, debt collection, civil litigation, and legislation. Interested law clerks are also able to serve in the administrative hearing office at the conclusion of their clerkship.

Although scheduling is flexible, clerks typically work full-time hours during the summer and part-time hours during the academic year.

While hiring for a legal Aide II , we will understaff with a Legal Aide I


 

The Legal Aide would assist DHHS in our work by:

  • Interpreting complex federal and state constitutional, statutory and regulatory laws and recognizing the impact of legislation on the agency and its programs

  • Drafting regulations and conduct privilege reviews for compliance with public records requests and discovery requests

  • Providing litigation support to the agency and Attorney General's Office, as needed, which may include the handling of appeals filed with the Nebraska appellate courts

  • Conducting research for agency attorneys; reviews, studies, searches, and annotates laws, court decisions,

  • Analyzing law sources to prepare drafts of briefs or arguments for review, approval, and use by attorney.

  • Writing memorandums relating to areas researched.

  • Preparing legal files and/or documents and/or correspondence such as briefs, affidavits, motions,

  • Subpoenas, petitions, or memorandums for use by agency attorneys.

  • Supervises the maintenance of the legal library and organizes current research data.

  • Assists in drafting legislative bills or amendments to legislative bills. • Assists in research, analysis and revision of agency rules and regulations.

  • Represents agency in administrative hearings under supervision of a licensed agency attorney


 

Requirements / Qualifications:

Minimum Qualifications:

Legal Aide I: Current enrollment in, and completion of one year of law school (approved by the American Bar Association) with successful completion of the first-year curriculum anticipated by June of 2025. 

Legal Aide II: Current enrollment at a law school (approved by the American Bar Association) with completion of legal studies sufficient to have attained senior standing

Other: Successful candidates will demonstrate: - Outstanding verbal and written communication skills, with the ability to communicate legal concepts accurately and concisely to a diverse audience; - Strong critical thinking, problem-solving, and cross-functional collaboration skills; - Ability to easily transition between diverse areas of legal practice and work environments; - Integrity, understanding of professional rules of ethics, and ability to manage confidential information; and - Competency related to the first-year law school curriculum.
