THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $92,917 - $115,937. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions.

The Service to State Agencies Section provides a full range of legal service, including litigation before State and federal tribunals, to a number of State agencies or agency components, including the Administrative Office of the Courts, the Department of Agriculture, the Department of State Treasurer, the Department of Natural and Cultural Resources, the Office of State Human Resources, the State Human Resources Commission, the Credit Union Division of the North Carolina Department of Commerce, the North Carolina Department of Information Technology and the Wildlife Resources Commission. The Section also provides legal services to a number of occupational licensing boards and commissions, including the Board of Hearing Aid Dealers and Fitters, the Irrigation Contractors Board, Pesticide Board, Structural Pest Control Committee, Plant Conservation Board, the Real Estate Commission, the Ethics Commission, the Marriage and Family Therapy Board, the Psychology Board and the Licensed Professional Counselors Board. In addition to serving these clients, the Section also provides legal advice to local government agencies through oral and written opinions to city and county attorneys, registers of deeds and other local elected officials.

The primary purpose of this position is to independently and with minimal supervision provide legal services to the Department of Information Technology (“DIT”). DIT is the State’s primary procurer and manager of information technology (“IT”) assets including hardware, software, IT project design and management, and IT security. DIT is charged with centralizing, standardizing and designing IT network architecture for all agencies in State government, working to ensure that state agencies follow standard principles of IT network design and internet access and with providing long term planning for North Carolina’s information technology infrastructure. DIT also provides all central telephony services and many mainframe computing services for State government in addition to coordinating implementation of new IT systems and services such as E-Commerce initiatives for government on a statewide basis. Local governments may utilize DIT services and contracts at their option.

The position is expected to serve as one of the lead Attorney IV to the statewide IT Procurement Section. Additionally, within the Department of Justice, this position independently and with minimal supervision provides information technology contracting review for other attorneys in the North Carolina Department of Justice. This position is recognized as the office’s expert on intellectual property and IT procurement matters. This position is expected to continue providing advice on large and small State DIT procurement contracts, conduct contract negotiations and draft procurement contract reviews. This position will occasionally prepare briefs for the State in criminal appeals to the North Carolina Court of Appeals and Supreme Court.

The salary grade for this position is LG09. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

Qualifications

Knowledge, Skills and Abilities / Competencies

Ability to independently conduct depositions, draft motions and bench briefs and with assistance conduct courtroom advocacy in cases that involve complex legal issues or facts.
Ability to litigate a variety of DIT-related matters in administrative, state or federal forums. • Ability to write clear, convincing and concise memoranda, opinions and correspondence.
Ability to draft legal documents, regulations and legislation.
Ability to establish and maintain effective working relationships with elected and appointed officials at all levels of government.

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and four years of progressively responsible professional legal experience.

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing. If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions, you must attach either a DD256 or NGB 22.
