Job Description
- Doctor of Jurisprudence Degree from an accredited law school; License to practice law in the State of Texas.
- Must have 5-10 years of civil litigation experience.
- Must have trial experience.
- Must have knowledge of IDEA, Section 504 and other federal, state, and local laws and regulations relating to public education law, employment law, procurement and contract law, and related issues affecting a school organization.
- Must demonstrate self-awareness, prioritize personal development, be honest, have integrity, be an active listener, be empathetic, have strong communication skills, and interpersonal skills, including but not limited to, the ability to understand human motivation and the ability to apply such knowledge to maintain good working relationships with district representatives, co-workers, subordinates and others.
- Assist the General Counsel in ensuring the operations of the Office of Legal Services in support of the goals and objectives of the District.
- Attend all board briefings, meetings, special called meetings, and committee meetings as directed by the General Counsel.
- Provide direction and assistance to legal staff as directed by the General Counsel during the General Counsel's absence from the office.
- Assist in the planning and development of legal policy and office procedures and processes for the district.
- Review requests for professional staff development and render appropriate training as approved by the General Counsel to the Board of Trustees and District staff.
- Assist the General Counsel in advising the Board of Trustees and Superintendent of Schools in the execution of contracts, the formulation and execution of policy and other legal issues.
- Assist with coordinating and overseeing timely compliance with subpoenas, including subpoenas for student records, employee records or other types of records.
- Accept and respond to notices of claims and demands against the district.
- Handle complaints, hearings and litigation related to employment matters, Special Education, Section 504, student discipline and appeals, and contract disputes.
- Represent the district in ARD Committee Meetings, Due Process Hearings, Mediation, TEA Appeals and/or agency proceedings, and litigation matters as directed by the General Counsel.
- Assist General Counsel in providing support and advice regarding district records, including, but not limited to requests made under the Texas Public Information Act and student records.
- Draft legal documents, rules and regulations, resolutions, applications of diverse kinds, inter local agreements, and all other legal or quasi-legal papers as needed.
- Negotiate and draft contracts for the acquisition of real and personal property, the employment of architects, contract management firms, contractors, and other entities.
- Review legislation introduced in the State Legislature and interpret the impact of such legislation on the interests of the District.
- Draft, edit or review district policies, processes and procedures and assist relevant departments in the implementation of those policies, processes and procedures.
- Counsel, guide, and train personnel on all facets of school law such as procurement laws, disability laws, and labor and employment laws and decisions (e.g., employment contracts, hiring, discipline, incentive programs, wage and hour, privacy, termination, benefits, teacher, administrator and staff evaluations, Family Medical Leave Act, Americans with Disability Act, discrimination, harassment, retaliation, employee grievances, administrative appeals and/or agency inquiries, responses, mediations, trial etc.).
