The Insurance Section of the Department of Justice litigates cases on behalf of several state agencies. The primary purpose of the Section is to represent the Commissioner of Insurance, the Department of Insurance, and Department of Insurance-affiliated boards and commissions such as the N.C. Building Code Council, the N.C. Code Officials Qualifications Board, the N.C. Manufactured Housing Board, the North Carolina Home Inspector Licensure Board, and the N.C. Fire and Rescue Commission.

This is an excellent opportunity for an experienced and independent litigator who wishes to gain some supervisory experience. The majority of the duties involve autonomously representing the Department of Insurance in complex, protracted litigation, including insurance company insolvency proceedings.  Additionally, the position provides legal advice to the Department of Insurance and to an assortment of boards and commissions associated with the Department of Insurance. The position will also supervise one Attorney III position which represents the State Auditor and the Secretary of State.   


You will learn interesting and complicated laws that offer protections to North Carolina citizens across the state, including - laws that protect citizens from insurance companies that collect insurance premiums, but are not sufficiently financially stable to pay out benefits; and, laws that protect citizens from unsavory business practices by insurance agents, bail bondsmen, collection agencies and charities.  


The major focus of this position is to represent the North Carolina Department of Insurance (NCDOI) in complex litigation before and during legal proceedings in federal court, state court, and in administrative hearings. The attorney in this position has responsibility for independently handling complex litigation and will be required to resolve important, difficult legal issues. In order to prepare for these cases, this attorney will independently determine the merits of litigation, will develop case strategies and tactics, and research novel points of law, some of which may involve issues of first impression. 

Responsibilities and Duties

1.  Represent NCDOI and its Employees in Litigation. 
  • The primary purpose of this position is to represent NCDOI in complex litigation and independently render litigation assistance and advice to the Commissioner, to the various divisions of NCDOI, and boards and commissions for which NCDOI has responsibilities.
  • This attorney represents the Agent Services Division of NCDOI in litigation of contested cases heard by an NCDOI Hearing Officer and on appeals to the Superior Court and appellate courts. These cases primarily involve the denials of insurance agents’ or bail bondsmen’s licenses and the suspension and revocation of such licenses.
  • This attorney will represent the Commissioner of Insurance in the most complex domestic insolvencies and will act as the lead attorney in those cases. This attorney can be expected to receive a significant number of the section’s most complex litigation cases.
  • This attorney is responsible for court appearances at the trial and appellate level, for conducting and defending depositions, for negotiating settlements as appropriate and is in most instances required to operate with maximum independence.
  • This attorney represents NCDOI’s Office of the State Fire Marshal (OSFM) in litigation and matters related to potential litigation. Litigation of these cases requires intense case preparation involving expert witnesses within the Division of Engineering.
  • This attorney is also responsible for representing OSFM and its employees who are subpoenaed as witnesses in civil lawsuits. This attorney must communicate with counsel for the parties issuing the subpoena and represent the employees at depositions and appear in court on the employees’ behalf as necessary.

2.  Advice to NCDOI and related Boards, and Commissions. 
  • This attorney independently provides legal assistance and advice to the Commissioner, to the various divisions of NCDOI, and boards and commissions for which NCDOI has responsibility and to all the agencies represented by the section. Responsibilities lie in all areas over which NCDOI has regulatory authority.  
  • The attorney in this position gives advice, counsel and assistance to the Agent Services Division with respect to matters involving the licensing of individuals and corporations as agents, compliance with the pre-licensing and continuing education requirements for licensee applicants and licensees. Further, this position participates in NCDOI-licensee conferences involving license denial, suspension and revocation.
  • This attorney also provides advice, counsel and assistance to  NCDOI’s Market Regulation Division regarding novel and emerging issues.

Note to Current State Employees: The salary grade for this position is LG09. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position.  Please detail ALL work history including non-state service experience.  If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result. THE STARTING SALARY FOR A NEW HIRE TO THIS POSITION IS LIMITED TO $89,775 to $115,937. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

Knowledge, Skills and Abilities / Competencies

Thorough knowledge of statutory, case and administrative law surrounding the regulatory authority of the clients represented. 
   
Thorough knowledge of jurisprudence and statutory case and administrative law surrounding the regulation of insurance companies and other entities licensed by the Department. 
   
Thorough knowledge of North Carolina rules of procedure, court and practice (trial and appellate), including the Revised Rules of Professional Conduct.
   
An in-depth understanding of the highly complex and unsettled issues and problems confronting the health care industry and personnel/employment law. 
   
Knowledge of federal laws affecting insurance and employer welfare plans (ERISA). 
   
This work requires the attorney to understand actuarial methodologies, jargon and concepts, information technology procedures, economics and statistics, actuarial and accounting principles, medical issues, engineering concepts, home construction concepts, various Federal government programs, and various other areas of technical expertise. 
   
Ability to independently analyze, interpret and act upon complex statutory provisions and case law. 
   
Ability to express conclusions and arguments correctly and logically in written and oral forms. 
   
Ability to apply good judgment and discretion to the exercise of job responsibilities. 
   
Strong and confident negotiation skills. 

Ability to effectively supervise an attorney, including the ability to coach, guide and perform supervisory duties on a timely basis.  

Ability to maintain an effective working relationship with the public and other persons contacted in course of work.
  
Ability to multi-task and prioritize case deadlines effectively. A demonstrated ability to effectively collaborate with management, colleagues and clients. 

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and four years of progressively responsible professional legal experience. NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.  

Management prefers the following:  experience/knowledge in administrative law, regulatory insurance laws, or representing boards and commissions, or a demonstrated ability to master highly technical areas of law; experience independently litigating complex cases in a variety of forums, including administrative tribunals and State and Federal courts; and, the ability to multi-task and independently prioritize case deadlines successfully.
