Job Description

Currently, we are hiring for 2 positions for Assistant Agency General Counsel I.


These Assistant General Counsel positions are responsible for providing legal advice, liability prevention strategies, and risk management services for the Department. The position will serve as an Assistant to a Deputy General Counsel and will assist in providing management with mature and experienced day to day legal services and guidance in all aspects of its functions. This position is intended to primarily support, though not exclusively, the Division of Institutions, Division of Comprehensive Health Services, and other divisions or sections as needed or assigned.

Responsibilities include, but are not limited to:

  • Provides legal advice for complex or novel legal issues, and is required to effectively interpret and apply laws, state and federal constitutional provisions, statutes, administrative regulations, and court decisions to facts specific to the Department’s operation
  • Works collaboratively with, and serve as a liaison to, the North Carolina Attorney General’s Office, specifically the Public Safety and Tort Claims Section, to assist in responding to discovery requests or to provide guidance as necessary, or as requested, regarding statutes, policies, and rules applicable to related litigation
  • Assists with policy development and the legal review of proposed policy documents, standard operating procedures, internal investigations, and other documents
  • Provides assistance with drafting, revising, and evaluating legal instruments, including contracts, memoranda of understanding, statutes or other legislative proposals, and settlement agreements
  • Assists in managing and responding to legal process the Department receives, including subpoenas and court orders
  • Upon request, the position will appear in Court on behalf of the State and as the Departmental representative at mediations and settlement conferences
  • Performs any additional legal duties assigned


Note: These positions ordinarily work forty hours a week, 8:00 am - 5:00 pm, Monday through Friday. The work schedule often extends beyond the eight-hour day, due to unanticipated demands requiring schedule changes. The employee is expected to work independently with periodic general review from the supervisor. Work occasionally requires travel within the state.

This is a full-time position (40 hours per week) withState Benefits.

If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY result.

Knowledge, Skills and Abilities / Competencies

  • Experience with statutory, case and regulatory law
  • Demonstrated knowledge of management principles, techniques and practices of the agency’s organization and objectives

Minimum Education and Experience Requirements

  • Licensed to practice law by the North Carolina State Bar and two years of progressively responsible professional legal experience.
