Job Description

Job Responsibilities

The person in this position will provide services and professional advice to the South Carolina Department of Education's (SCDE) Office of Education Choice and Family Engagement, including drafting and/or reviewing Methods of Administration (MOAs) and other documents as needed. Draft memos for agency and district guidance and notice to districts regarding education choice initiatives and policies in South Carolina. Assist in educator misconduct cases by reviewing evidence, interviewing witnesses, preparing cases for trial and present cases, negotiating consent agreements, drafting orders, and presenting cases to the State Board of Education. Prepare records and arguments for appeals to the Administrative Law Court. Provide assistance with the agency's compliance of the Freedom of Information Act. Ensure agency's policies and practices are in compliance with state law. Provide legal review of document production as necessary. Provide direct representation for the SCDE in employment grievance matters and administrative and civil cases involving employees. Respond to court subpoenas and information requests from other state agencies involved in teacher discipline matters. Perform other duties as assigned.  

This position is located in the Office of General Counsel.   

Minimum and Additional Requirements

A juris doctor degree or its equivalent from an accredited law school and experience as a practicing attorney.

Preferred Qualifications

Knowledge of the laws of South Carolina. Knowledge of the theories of legal research. Ability to interpret and apply law and judicial decisions. Ability to prepare opinions, briefs, pleadings and other documents. Membership in the South Carolina Bar within six months of employment.
