The Associate Fiduciary Attorney is responsible for thorough oversight of fiduciary personnel and documentation. The incumbent will ensure that Bryn Mawr Trust and The Bryn Mawr Trust Company of Delaware has minimal exposure to legal liability, complies with all applicable fiduciary, federal and state regulatory and tax laws, has the tools to make sound business decisions as to new and closing accounts, and provides exceptional service to its clients. 

Job Responsibilities: 

  • Provide day to day legal guidance to BMT and BMT DE team members in the exercise of their fiduciary responsibilities.
  • Review all legal documents in conjunction with surrounding facts & circumstances including incoming fiduciary business to ensure that the business is sound and appropriate for Bryn Mawr Trust and Bryn Mawr Trust of DE.
  • Make recommendations as to any changes possible to bring the business within the appropriate scope for Bryn Mawr Trust/BMT DE to handle.
  • At key stages of a fiduciary relationship with Bryn Mawr Trust/BMTDE (death of settlor or beneficiary, termination due to age, exercise of right of removal, etc.), review and oversee the legal documentation and legal processes so that Bryn Mawr Trust/BMT DE may be released, indemnified and as fully protected as possible from any liability.
  • Work closely with outside trust counsel.
  • In conjunction with Legal Team, guide Senior Management as to the legal and regulatory risks of taking or not taking key actions.
  • In consultation with the Legal Team and others, recommend and oversee the development and implementation of appropriate new and/or updated Policies and Procedures to stay current with fiduciary laws and the regulatory authorities.
  • Support and provide legal guidance to administrative committees of Bryn Mawr Trust and BMTDE.
  • Stay updated on changes to relevant fiduciary, trust and estate law, represent the bank at COI and CLE events.

Minimum Qualifications:

  • J.D. required.
  • At least 2-3 years Delaware trust and estates experience as an attorney.
  • Delaware bar license preferred, Pennsylvania accepted.
  • In depth knowledge of trust and estate law, fiduciary principles and Delaware’s Directed Trust Act.
  • Must possess strong analytical and problem solving skills to navigate complex trust structures.
  • Must have excellent communication abilities to engage with HNW clients and collaborate with financial professionals.
  • Must have experience in trust and estate administration, tax planning, resolving fiduciary disputes.
  • Knowledge and experience related to bank/wealth regulatory issues is a plus. 
  • Knowledge of Nevada trust law also a plus.
