Job Description

The mission of the New York City Police Department is to enhance the quality of life in New York City by working in partnership with the community to enforce the law, preserve peace, protect the people, reduce fear, and maintain order. The NYPD strives to foster a safe and fair city by incorporating Neighborhood Policing into all facets of Department operations, and solve the problems that create crime and disorder through an interdependent relationship between the people and its police, and by pioneering strategic innovation.

The Office of the Deputy Commissioner of Legal Matters provides legal guidance to the Police Department and is responsible for advising all members of the Department on all legal matters affecting the Department, including major criminal and civil litigation and important legislative and judicial developments. The office monitors and facilitates the relationship between the Department and the rest of the criminal justice system and assists members of the service in interpreting and enforcing state, federal, and local laws; ensures that the policies and practices of the department are lawful and are fairly applied; and develops legislation in accordance with the needs of the Department and public safety concerns.

Under supervision, with some latitude for independent judgment and unreviewed action and decision, performs legal work, including the following:
-Researches and prepares routine cases for trial and argues them before courts or quasi-judicial bodies. May assist in research preparation and trial of complex cases.
-Performs legal work involving issues of fact and questions of law, including tax law.
-Appears in court and at administrative hearings to argue motions, writs and petitions and other similar matters.
-Prepares briefs, motions, legal opinions, affidavits, memoranda and other legal papers.
-Negotiates, drafts and processes contracts, conveyance documents, loan documents and other agreements, and attends real estate closings
-Recommends statutory and regulatory revisions related to agency issues. Drafts and
-Reviews proposed legislation, rules and regulations.
-Determines the advisability of presenting witnesses, admissibility of types of evidence and
matters of legal strategy.
-Confers with subject matter specialists, technical experts, and other attorneys, including counsel for litigants.
-Recommends settlements and adjustments.
-Conducts legal investigations, holds informal hearings, and examines prospective witnesses.
-Advises on legal aspects of enforcement and administration of acts, rules, laws, and regulations.
-Determines which legal and/or other questions require more legal analysis or review and refers them with appropriate memoranda to the proper authority.
-May assist in training and supervising the activities of subordinate staff. Guides, supervises and/or reviews work of support staff to ensure completeness and compliance with agency policy and professional standards.
-May act as liaison with operational staff within the agency

Qualifications

1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
In addition to meeting the minimum Qualification Requirements:
To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
