SUMMARY:
This position will team with senior level attorneys to represent MEM and/or its policyholders in in workers' compensation litigation primarily through settlement while assisting senior attorneys with discovery, trial, and appeal, and issuing advisory opinions on legal issues, including issues of policy inception and coverage as appropriate.

LITIGATION ATTORNEY ACCOUNTABILITIES
- Perform job duties in accordance with MEM’s vision, mission and values.
- Attend conferences, prehearings, and mediation settings, and negotiate and settle claims.
- Provide legal advice to claims, other company personnel, and policyholders as requested. Communicate with the court, witnesses, opposing counsel and co-counsel with professional diplomacy and discretion.
- Facilitate prompt, efficient and effective disposition of assigned cases.
- Assist with the preparation and presentation of witnesses and evidence at depositions, trials, judicial/administrative hearings, mediations, arbitrations and alternative dispute resolutions.
- Prepare pleadings, written discovery, depositions, motions and briefs in support of defense strategies with autonomy.
- Prepare legal documents and memoranda.
- Negotiate settlement of workers compensation claims pursuant to authority granted by claims representatives on an as needed basis.
- Conduct legal research and prepare written opinions as well as give informal advice to claims representatives, claims management and other departments.
- Contribute to the management of partnering relationships with internal clients, particularly the claims team, building effective working relationships and providing high-quality professional services to support in delivering business strategy and plans.
- Advise claims department personnel and policyholders of claims litigation plans and important litigation developments.
- Assist and advise claims subrogation personnel as needed to protect, and collect on, MEM’s third-party actions.
- Attend continuing legal education seminars in order to maintain high level of professional expertise.
- Other assignments as directed by the Managing Attorney, Vice President of Claims, General Counsel’s office, or other Executive Officers and staff.
QUALIFICATIONS:
Education:
Juris Doctor Degree - Licensed in Kansas and/or Missouri
Licenses
- A valid drivers’ license is required.
Experience:
- A minimum of one year of experience of trial, administrative hearings, appellate, or workers’ compensation experience preferred.
