
This entry-level position provides legal representation for Exchange policyholders to protect their interests in the defense of personal injury and/or property damage lawsuits. The position also provides legal representation for the Exchange to defend and/or protect its interest in subrogation actions, medical payment reimbursement, and other legal actions. In addition, this position provides legal research and opinions to the business units of the Exchange.
Job Duties
Analyzes cases to determine all pertinent facts and develop appropriate legal theories/strategies in the defense of lawsuits. Identifies potential exposure to policyholders or the Exchange. Develops and implements appropriate discovery plans and motions, as needed. This includes propounding and answering written discovery, subpoenas, and review of records, taking depositions, and drafting and opposing motions. Meets tight deadlines for internal assignments and court filings. Responds to Department of Insurance complaints and to subpoenas (Missouri).
Prepares for, attends, and defends all court proceedings related to cases including trials. Will also prepare for and attend mediations and arbitrations. Will try small claims appeals, limited jurisdiction, small claims (Missouri), Associate Circuit Court (Missouri), and smaller value Circuit Court cases (Missouri). Researches and prepares trial, motion, and appellate briefs.
Regularly communicates to management an overview of the case facts. Identifies issues of liability and damages, sets forth legal defenses and strategy recommendations, provides discovery plans, and provides opinions on value or any other pertinent information. Regularly communicates with policyholders and claims representatives regarding development of specific cases. Communication includes providing written summaries of discovery, depositions, records and significant developments on cases.
. Researches and prepares legal opinions on any unique issues arising from the handling of a case, including coverage (Missouri).
Participates in negotiation and settlement of cases on behalf of the Exchange or its policyholders with outside parties/entities. Collects settlement amounts.
Performs other duties and responsibilities as assigned or required.
Defense of the file requires basic understanding of the law and its proper application to the facts of the case. Incumbent evaluates cases for both liability and value, and makes decisions in collaboration with Claims on the legal strategy. Regularly seeks guidance from Managing Attorneys especially on complex issues, or in preparation for trial or arbitration.
Qualifications
JD Required
1-3 years Insurance defense law Preferred
Insurance background helpful, but not required.
Some knowledge of trial procedures and the rules of the evidence.
Valid Driver's License, acceptable Department of Motor Vehicles record and minimum liability insurance - Issued by State Required
The starting pay range for this position is:
$90,400.00 - $120,300.00Additionally, for full time positions, you will be eligible to participate in our incentive program based upon the achievement of organization, team and personal performance.
