We are seeking a detail-oriented Paralegal with experience in intellectual property portfolio management, to join in-house legal team. Provide support with general corporate maintenance and intellectual property portfolio management. Critical function of the legal department. Responsible for the maintenance of the company's legal documents and portfolio of intellectual property worldwide.
Responsibilities:
• Support legal department's day-to-day and strategic needs.
• Support ongoing litigation by maintaining filings and docketing and calendaring important dates and deadlines.
• Maintenance and organization of Company's corporate documents, agreements, and other legal files. Maintenance includes filing and regularly updating agreements using Company's Contractworks database, as well as calendaring reminders for expiration dates and renewal deadlines.
• Assist in preparing standard contracts such as Non-Disclosure Agreements, Copyright Assignments, and Foreign Employment Agreements for review by Assistant General Counsel.
• Preparation of signature packages for corporate documents.
• Maintenance of a portfolio of trademark and copyright records. Maintenance includes the timely filing of new TM applications, legalization of related documents, submissions of Extensions of Time to File and Statements of Use, Affidavits of Use and Renewals with the USPTO, applications, proofs of use and renewals in all foreign jurisdictions for marks.
• USPTO submissions including but not limited to, Responses to Office Actions, as well as Opposition proceeding documents with the USPTO's Trademark Trial and Appeal Board. Weekly maintenance and reporting to attorneys of Opposition Status as well as data-base input of the same.
• Monitoring the actual use of our trademarks in the US and abroad. This includes constant communication with all merchandise divisions to ensure the existing registrations are valid and not vulnerable to cancellation due to non-use.
• Creation of annual schedules and periodic reminders to all involved brand and merchandise divisions regarding pending renewals, affidavits of use and proofs of trademark usage as required by jurisdiction.
• Administration of assignments for newly acquired trademarks in the US and all foreign jurisdictions.
• Daily monitoring of TM watch notices and reporting potential infringements to in-house counsel and/or to foreign counsel. Coordination and compilation from all related departments, any evidence to be used in infringement matters and relaying same to outside/foreign counsel.
• Assist in conducting in-house searches of potential new trademarks and style names for all merchandise divisions. Searches include detailed US, State and International registers using Serion databases as well as common-law searches on the internet.
• Overseeing and coordination of trademark recordation with China Customs, including coordinating and obtaining authorizations and consents from third parties for China customs recordation.
• Overseeing and coordination of factory authorizations in China, including, communicating between production teams, third-party licensors, and China counsel.
• Assisting in the arrangement for timely releases of authorized goods which are delayed in foreign and domestic ports.
• Direct communication with and between foreign and in-house counsel in all phases of trademark prosecution and litigation.
• Daily management of outside counsel billing and invoices, including analysis and approval of all legal invoices using Docuware.
• Preparation of FedEx packages and labels.
