THE RECRUITMENT RANGE FOR THIS POSITION IS LIMITED FROM $116,147 to $132,998. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

The attorney in this position is within the Special Litigation Section and assigned to represent the Department of Health and Human Services and its officials in complex, protracted or high profile cases. These actions may include personal injury jury trials, medical malpractice cases, class action lawsuits in State and Federal Court, Civil Rights actions and such other matters and complex litigation as may be from time to time assigned by the Department.  The cases assigned to this attorney will be diverse and challenging, and will directly impact the client's legal and fiscal condition. The assignment of these cases contemplates professional and proficient representation during all litigation events including the drafting of pleadings, voluminous discovery, pretrial hearings, trial, and all appeals. This attorney will further advise on all litigation and policy issues, including sensitive and confidential matters subject to provisions of confidentiality. This attorney may further be requested to draft legal opinions or advise on risk-management issues.

This attorney represents the Department of Health and Human Services and its officials. Consequently, this attorney must have thorough knowledge of the applicable Rules of Civil Procedure and trial practice in all North Carolina Courts, as well as all Federal Courts including the Fourth Circuit Court of Appeals and must be able to handle the most complex litigation and work with numerous heads of State Agencies as well as the Section Heads assigned to other DOJ sections.  The attorney must be thoroughly knowledgeable of all of the Department’s policies and procedures.

This position handles criminal appeals for the State of North Carolina before the North Carolina Court of Appeals and Supreme Court as assigned by the Attorney General.

Note to Current State Employees: The salary grade for this position is LG10. State employees are encouraged to apply for positions of interest even if the salary grade is the same as, or lower than, their current position. If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

Knowledge, Skills and Abilities / Competencies

Management Preferences: 

  • Ability to conduct complex civil or criminal litigation in trial and appellate courts.
  • Ability to interpret and apply laws, constitutional provisions, statutes, administrative regulations, and court decisions.
  • Ability to determine issues in various cases.
  • Well-versed in legal research and writing, oral advocacy, and overall litigation strategies.
  • Extensive and expert knowledge of the N.C. Rules of Civil Procedure, the N.C. Rules of Evidence, the N.C. Rules of Appellate Procedure, and any other related statute, regulation or code.

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and five years of progressively responsible professional legal experience.

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Veterans Preference: Applicants seeking Veteran's Preference must attach a copy of their DD-214 or discharge orders.
 
Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing.  If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions, you must attach either a DD256 or NGB 22.
