Description

The Associate Counsel provides legal support to the Network, its subsidiaries and affiliates, and employed healthcare professionals. The Associate Counsel assists the CLO and Deputy General Counsels (“Deputy GC’s”) with the management of all contractual matters for the Network, especially vendor contracting and management. The Associate Counsel also will be responsible for performing legal research, advising and educating Network stakeholders, revising policies and procedures to comply with regulatory updates, and supporting the Network’s response to governmental and accreditation surveys and audits. The Associate Counsel will be expected to have strong practical knowledge of HIPAA, Stark, Antikickback, and other healthcare regulatory schemes to protect and minimize risk for the Network. The Associate Counsel evaluates legal and risk issues affecting the Network and its employed healthcare providers. The Associate Counsel provides legal support to the CLO, the Deputy GCs, the executive team, and other stakeholders in the legal affairs of the Network. This position will require depth of knowledge and analytical skills to assess risk, and professional poise and polish to interact with members of various Network leaders, physicians, and staff. All job duties are to be performed in a manner that demonstrates commitment to servant leadership and supports the Mission and Core Values of The Christ Hospital. 



Responsibilities

Directs and supports a wide variety of health care procurement strategies and activities ranging from as-a-service engagements and BAAs through supply agreements and NDAs. Direct and support physician and other clinical engagements ranging from physician employment agreements to clinical education and research agreements. Monitor and measure performance of contracted parties against expectation, partner with business units to provide strategic direction, and right-size relationships as necessary.  

Directs or assists the Network in managing disputes ranging from employment and contract to payor and medical-legal matters. 

Performs legal research. Develops expertise in applicable healthcare regulations and stays current on regulatory updates affecting the Network. Provides regulatory and strategic advice and education to Network stakeholders as needed in compliance with applicable laws. Revises policies and procedures to comply with regulatory updates. Supports the Network’s response to governmental and accreditation surveys and audits.

Provides general legal support to the Chief Legal Officer and Deputy GCs.

Accepts Legal Services call obligations; responds to clinical-legal matters as necessary.



Qualifications

EDUCATION:     J.D. from an American Bar Association accredited law school.        

YEARS OF EXPERIENCE:  3+ years of experience at a law firm or healthcare system                                      

REQUIRED SKILLS AND KNOWLEDGE:     Minimum 3 years of experience with and working knowledge of healthcare law and legal principles, with particular focus on healthcare arrangements and healthcare regulatory matters.  Familiarity with healthcare, risk management, contracting, and laws and regulations impacting the Network, including HIPAA/HITECH are required.  Experience with not-for-profit corporate and governance matters and health care finance preferred.
