THE POSITION

The Office of Small Business Advocate (OSBA) is looking for a dynamic and innovative Deputy Attorney to join our team. This leadership role involves providing legal counsel and support to the agency's executives, attorneys, and expert witnesses, as well as overseeing case management. The Deputy Attorney will play a crucial role in ensuring the effective execution of all legally mandated litigation and mission-driven initiatives. Furthermore, this position will focus on maintaining compliance with regulations and laws within the public utility sector while promoting and enhancing Pennsylvania's influence in the energy and utility landscape. The ideal candidate will be adept at articulating and advocating for the interests of small businesses throughout the Commonwealth at both state and national levels. DESCRIPTION OF WORK

In this position, you will oversee, guide, and manage the activities of attorneys and legal personnel to fulfill the OSBA’s mission, vision, and stance on legal issues. You will represent the OSBA in litigation before the Public Utility Commission, appellate courts, and during administrative proceedings. Additionally, you will direct and coordinate case assignments for expert witnesses, providing guidance on the preparation of testimony, motions, and briefs. In collaboration with the Senior Attorney and Small Business Advocate, you will identify and recommend issues for litigation. You will also develop and support the implementation of statewide programs, policies, and protections for small businesses in conjunction with the Small Business Advocate. Furthermore, you will advise and assist the Small Business Advocate in promoting policy priorities, which includes drafting legislation, rulemakings, and legislative comments. It is essential to review, analyze, and stay updated on decisions from the Public Utility Commission, Federal Energy Regulatory Commission (FERC), Federal Communications Commission (FCC), and appellate courts regarding public utility and administrative law matters.

Work Schedule and Additional Information: 

  • Full-time employment
  • Work hours are 8:30 AM to 5:00 PM, Monday - Friday, with a 60-minute lunch.
  • Telework: You may have the opportunity to work from home (telework) part-time, up to 2 days per week. In order to telework, you must have a securely configured high-speed internet connection and work from an approved location inside Pennsylvania. If you are unable to telework, you will have the option to report to the headquarters office in Harrisburg.
  • Salary: In some cases, the starting salary may be non-negotiable.

REQUIRED EXPERIENCE, TRAINING & ELIGIBILITY

QUALIFICATIONS
Minimum Experience and Training Requirements:

  • Ten years of professional legal experience and graduation from an accredited school of law; or
  • An equivalent combination of experience and training. 

Post Employment Requirement:
  • Applicants must be certified for admission to the Bar of the Supreme Court of Pennsylvania and must maintain membership on a continuous basis during employment.

Additional Requirements:
  • You must have a license to practice law in Pennsylvania.
  • You must have at least ten years of public utility law experience.
  • You must have at least ten years of supervisory experience.
  • You must have litigation and settlement negotiation experience.
  • You must be able to perform essential job functions.
