The Senior Counsel will enable PMI's Smoke Free Future vision in the U.S. by providing legal support for the U.S. Inhalables Commercial team as they design and implement marketing and commercial plans to reach business objectives in a manner consistent with all relevant laws and regulations, and PMI standards and perspectives. This role reports to the Assistant General Counsel, Inhalables.
Your ‘day to day’:
- Understand the relevant legal and federal, states and local regulatory framework for the commercialization of PMI smoke-free products in the U.S., and company positions; anticipate, identify and articulate relevant potential legal risks, develop innovative legal solutions to enable business initiatives and vigorously defend the company against external head winds.
- Ensure commercial plans and operations comply with applicable laws and regulations including state and local licensing, federal and state fair competition laws, the FDA Tobacco Control Act, etc.
- Establish effective working relationships with team and Legal Department members and work in partnership with the business to deliver quality, proactive and pragmatic business-centered advice designed to avoid or minimize exposure to legal liability.
- Lead cross-functional and departmental initiatives.
- Manage all aspects of legal projects including design, development and implementation.
- In coordination with External Affairs and with the supervision of the Assistant General Counsel, represent the company’s position before responsible government agencies and regulatory bodies in the jurisdictions in which PMI operates.
- Follow regulatory and industry developments in the U.S. affiliate’s and PMI’s business to ensure legal compliance, identify legal issues for management and support the development of relevant programs (including trainings) to manage the risks.
- Draft, review and negotiate a wide range of agreements with suppliers/vendors, customers, distributors, partners, resellers and other third parties.
- Direct counsel resources to enable delivery of quality, effective and efficient legal support to the affiliate at a reasonable cost and in accordance with the Philip Morris International Guidelines for Outside Counsel.
- Collaborate with relevant global legal subject matter experts to ensure consistency in quality legal advice.
- Other projects as assigned.
Who we’re looking for:
- J.D. from an accredited law school and licensed to practice law in a U.S. jurisdiction.
- At least 8 years of concentrated experience which demonstrate an in-depth knowledge and applied understanding of commercial practice; experience counseling sales and marketing professionals a plus.
- Both in-house and major law firm experience preferred, experience in regulated industry context a plus.
- Previous managerial and leadership experience preferred.
- Legally authorized to work in the US.
Annual Base Salary Range: $217,500-$290,000
