The Senior Attorney in this practice is responsible for providing legal advice and services in the areas of employment law and litigation and traditional labor law. The ability to provide legal advice concerning employee benefits matters is desirable, but not required. This position also plays a key role in managing outside counsel and their costs. Provides assistance with Global Business Conduct cases regarding employee investigations and discipline arising out of violations of company policy
Creates and delivers employment law-based training programs to management and general employee audiences
Manages litigation arising out of employment law claims
Manages statistical analyses for pay equity, compensation review, variable compensation and reductions-in-force
Advises on use of temporary and contract employees and prepares/negotiates service agreements with temporary labor providers
Addresses all employment law issues in divestitures and acquisition
Advises on employment contracts, non-competition agreements, confidentiality clauses (in collaboration with Intellectual Property attorneys) and enforcement of the same
Advises on workers compensation cases
Advises on Human Resource workplace policies (drug/alcohol, security/workplace violence)
Advises on workplace closing, staffing reductions, redeployments, severances issue, and required WARN notifications
Advises on HIPAA and state-based privacy issues
Provides legal support for Department of Labor reviews of plans, information requests, and correction procedures
Provides counsel in the interpretation and negotiation of collective bargaining agreements; assist in interim bargaining
Defends charges under the National Labor Relations Act: unfair labor practices, grievances, and arbitrations
Provides training for management on union-free workplaces, and defense of charges under the National Labor Relations Act
Drafts workplace policies consistent with labor law and “protected activities”
Provides support to Compensation/Benefits organization and to Treasury organization (when applicable) regarding plan amendments, new plan features, annuity lift-outs, discontinuation of benefits and plan terminations
Collaborates on and reviews all communications to plan participants, including year-end election materials
Serves as counsel to Eastman’s fiduciary committees assisting in agenda preparation, parliamentary conduct of meetings, composition of minutes, decisions regarding adequacy of fiduciary review
Provides training and periodic legal updates to Eastman’s fiduciary committees
Manages benefits-based litigation and plan appeal process
Drafts, reviews and assists in negotiation of administrative services agreements
Advises Company employee service center regarding employee and participant requests
Advises on benefit interpretations and benefits offered in collective bargaining agreements
