Overview & Responsibilities

PURPOSE OF THE JOB

The Commercial Litigation Counsel is a mid-level position within Elliott’s Legal Department whose role is to facilitate and partner in strategic analysis and management of Elliott legal matters worldwide, with the goal of forging pathways toward risk mitigation and commercial resolution.

This position will report directly to Senior Commercial Counsel and will coordinate in the efforts of the Legal Department to effectively service Elliott internal clients, i.e. Executives, Finance, Operations, Quality, Environmental Health and Safety, and Human Resources. As the Company continues its global expansion and growth, the Commercial Litigation Counsel will function to advance and fulfill strategic business goals through creative analysis, innovation, and conflict resolution.

BACKGROUND and EXPERIENCE

  • Doctor of Jurisprudence from an accredited law school.

  • Minimum Licensures:  Admitted and in good standing to the Commonwealth of Pennsylvania Supreme Court (no lapse in license).

  • Minimum 5 - 7 years of business or commercial litigation experience with a law firm or in-house – experience with manufacturing clients is preferred.

  • Candidate must be a team player and must be able to multi-task and manage various types of legal issues.

  • This position requires development and implementation of creative commercial and business solutions for complex circumstances in a global environment. 

  • Excellent research, writing and communication skills are necessary to effectively perform the functions of this position; The individual must be able to speak in a persuasive, confident and effective manner, and to present recommendations in a succinct and concise manner.

  • The candidate must be proficient in Microsoft applications including Word, Excel, PowerPoint and Access.

  • Knowledge and experience with Gmail and Lotus Notes are preferred.

A writing sample is required to be provided with the candidate’s application for employment.

SPECIFIC JOB RESPONSIBILITIES/COMPETENCIES

The specific responsibilities shown here are in descending order.  Since this position functions in an atmosphere of multiple changing priorities, the least important duties may become the most important duties at any given time.

As the Legal Department provides support to Elliott operations worldwide, the position requires sound critical thinking and analytical ability, as well as good interpersonal and problem solving skills, and a clear appreciation and focus on the importance of facilitating operational goals and mitigating commercial and legal risk.  It requires a background in litigation, legal research and writing skills, and an understanding of business and contracts.  This position requires the individual to be well-organized, able to multi-task, and to respond to requests in a timely manner in order to address tight deadlines.  The individual needs to be flexible, with an ability to prioritize, as the demands of each day can vary greatly.  Planning is an essential/key element in every aspect of this job function. 

The specific job responsibilities include, but are not limited to, the following:

  • Assist with the strategic analysis/planning of the defense of Elliott in anticipated or current litigation.

  • Prepare case assessment documentation and summaries that will highlight key issues involved and prepare detailed timelines of the matter at hand

  • Review work product of outside counsel and modify, as needed and required, to appropriately defend Elliott

  • Gain an understanding and working knowledge of the Company equipment/products manufactured/distributed over the decades to be conversant in same so as to support litigation/trial strategy and prepare witnesses and experts for testimony

  • Present important legal developments to the Company

  • Maintain professional license and skills by regular participation in continuing legal education and business seminars and by reading professional materials

  • Ensure that appropriate legal support functions are provided in a cost-effective and timely manner; and

  • Other matters as requested to support the Elliott Legal Department on a daily basis.
