Position Overview

The Illinois Department of Revenue is seeking to hire an Income Tax Litigation attorney to represent the Department in administrative protests and hearings involving income tax assessments, claim denials and penalties. Under general direction, the ideal candidate will have knowledge and experience in litigation, civil procedure, state and federal tax laws, and administrative and regulatory functions. This position is an excellent opportunity for an attorney looking for hands-on litigation experience while advancing the Department’s objectives of fair and efficient tax administration.

Essential Functions
  • Under general direction, researches and analyzes routine court case appeals, court rulings, court decisions, tax statutes, tax regulations, field audits, investigative reports, documents of public record and other material submitted by taxpayers and the Illinois Department of Revenue (IDOR) auditors to prepare for hearings.
  • Confers and corresponds with taxpayers, their representatives, attorneys and other interested parties regarding the application or interpretation of the Income Tax Act, rules and regulations and applicable case law.
  • Represents IDOR in all phases of routine litigation hearings and status conferences involving Income Tax protest and refund claim cases that are in dispute.
  • Confers with supervisor to resolve difficult or complicated cases involving compliance and/or statutory interpretation and its application to specific Income Tax issues.
  • Assists higher level staff in conducting litigation cases, hearings and general law duties relative to all taxes administered by IDOR.
  • Performs other duties as required or assigned which are reasonably within the scope of duties enumerated above.
Minimum Qualifications
  • Requires graduation from a recognized law school.
  • Requires possession of a valid license to practice law in Illinois.
Preferred Qualifications
  • Two (2) years of experience working with judicial and quasi-judicial procedures and rules of evidence.
  • Two (2) years of experience working on cases or controversies involving common law and the provisions of state and federal laws relating to administrative and regulatory functions.
  • Two (2) years of experience litigating cases.
  • Two (2) years of experience using all primary and secondary legal source materials, to analyze all legal documents and instruments and to prepare, conduct and report formal or informal administrative hearings.
  • Two (2) years of experience analyzing, appraising, and organizing facts, evidence and precedents and in presenting such material, involving a moderately complex problem, in clear and logical form in written media as briefs, memoranda, summarizations, research reports or regulations.
Conditions of Employment
  1. Requires the ability to successfully complete a tax compliance and fingerprint-based background check.
  2. Requires ability to travel in the performance of duties, with overnight stays as appropriate.
  3. Requires the ability to use and secure a state issued mobile device, e.g., cellular phone, laptop computer, tablet, etc.
