Job Description:

The Transportation Bureau of the Nebraska Attorney General’s Office is seeking applicants for the position of Assistant Attorney General (“AAG”) in the Office’s Transportation Bureau. The AAG shall represent the state in court and shall serve as one of five in-house legal advisors for the Nebraska Department of Transportation.

The selected attorney will be responsible for the following duties within the Transportation Bureau:

Providing legal advice to the Nebraska Department of Transportation (NDOT) concerning NDOT’s procurement of goods and services.  Applicant will need to develop a complete understanding of applicable Nebraska procurement law.

Serving as the lead attorney for the drafting and enforcement of contracts of various types for NDOT. Applicant will be expected to have excellent research and writing skills.

Assisting and advising NDOT and its consultant with review of draft documents for the development of NDOT alternative delivery construction projects (Design Build, Progressive Design Build, Construction Manager/General Contractor and Public Private Partnerships).  Applicant will also be responsible for advising NDOT on Nebraska law aspects of such project contract documents.

Developing technical expertise concerning NDOT’s Insurance requirements for various contracts, permits, and other situations.  Applicant will also be responsible for reviewing Certificates of Insurance to determine compliance with contract and permit insurance requirements.

Handling or assisting with various NDOT litigation files.

Taking the lead on other Bureau related legal counsel work, as assigned.

Be a member of a small but dedicated group of attorneys who specialize in issues unique to the Nebraska Department of Transportation.


 

Requirements/ Qualifications

Minimum Qualifications: Graduation from an ABA accredited law school and a license to practice law in Nebraska, or clear ability to be licensed in Nebraska by motion; Excellent legal writing skills and demonstrated work ethic.

Preferred Qualifications:  At least one year of work comparable to some or all of the duties set out above.  Also preferred, three or more years of civil litigation, appellate advocacy, or administrative litigation experience.  Prior experience handling successful litigation in high profile cases strongly preferred.

Salary commensurate with comparable state agency positions and candidate experience. Full-time state benefits available. The Assistant Attorney General will work from the Nebraska Department of Justice’s office located within the Offices of the Nebraska Department of Transportation in southwestern Lincoln.
