Job Description:

POSITION OBJECTIVES
The Assistant City Attorney provides legal advice to the City Council and the various departments with the City of Port Orange, as directed by the City Attorney.
ESSENTIAL FUNCTIONS
Essential functions are those functions actually required to perform this position, the removal of which would fundamentally change the job. These are intended only as illustrations of various types of work performed. The omission of specific duties does not exclude them from the position if the work is similar, related, or a logical assignment to the position.
•Prosecutes City Ordinance violations and provides legal guidance to the Code Enforcement division and Police Department.
•Pursues forfeiture and risk protection actions on behalf of the City.
•Defends the City in miscellaneous civil litigation, including appeals.
•Provides guidance related to labor and employment matters and represents the City in grievances, arbitrations and labor negotiations related to the same.
•Drafts ordinances and resolutions for City Council adoption.
•Reviews development plans and drafts legal documents in compliance with the Land Development Code.
•Conducts complex legal research and prepares memorandums of law.
•Attends meetings and hearings as needed.
•Prepares documents for adoption of laws, implementation of laws, and enforcement of laws including policies, civil and criminal proceedings in county and circuit courts.
•Supervises legal assistant, and paralegals.
•Performs other related duties as assigned. These additional duties may be representative of tasks typically performed by those in a lesser or more advanced job grade.

This position is part of the City’s Emergency Management Team and, as such, shall be expected to perform all duties that are assigned during an emergency management operation. Any additional compensation, above the normal weekly salary shall be outlined by the City Manager in the City’s Emergency Management Activation and Emergency Declaration. Failure to appear to perform emergency management assignments and to work assigned shifts as scheduled by the City’s Emergency Management Personnel or individuals designated by the City Manager to assign such functions will result in disciplinary action up to and including termination.

SUPERVISORY RESPONSIBILITIES
•Directly supervises paralegals and legal assistant.
•Carry out supervisory responsibilities may include interviewing, hiring, and training new employees; planning, assigning, directing and reviewing work; mentoring, motivating, coaching and appraising performance; rewarding and disciplining employees; addressing complaints and resolving problems in accordance with the organizations policies and applicable laws.

QUALIFICATIONS
Education and Experience
•Graduation from an accredited law school.
•0-5 years of legal experience preferably in governmental sector or any equivalent experience.

Certifications, Licenses, and Registrations
- Admission to State Bar of Florida.


Knowledge, Skills, and Abilities
•Knowledge of Federal, State, County, and local laws, regulations, and established precedents affecting the City government.
•Knowledge of labor and employment law, workers’ compensation and tort litigation.
•Knowledge of ordinances and charter provisions relating to the authority and functions of the City departments, boards, and ordinances.
•Knowledge of judicial procedures and rules of evidence.
•Be familiar with the Sunshine Law, Public Records Law.
•Ability to function effectively during periods of high pressure, such as union negotiations and emergency management.
•Ability to analyze and prepare a wide variety of legal documents.
•Ability to communicate effectively both orally and in writing.
•Ability to analyze and prepare legal documents, contracts, proposed ordinances, resolutions, and policies.
•Ability to conduct research legal problems and to prepare sound legal opinions.
•Ability to comprehend and apply principles of mathematical concepts as applied to this position.
•Ability to exercise judgment and discretion in applying and interpreting organizational rules, regulations, policies and procedures.
•Ability to maintain legal confidentiality of all communications relating to City business.
•Ability to conduct complex research, analyze, interpret and report findings and to make conclusions and recommendations that can be legally supported.
•Ability to use personal computer and other standard office machines and equipment.
•Ability to establish and maintain effective, courteous working relationships with public officials, peers, other divisions and departments, and citizens.

Ability to remain calm in stressful situations and to take a teamwork approach to the job by cooperating with others, offering to help others when needed, and considering larger organization or team goals rather than individual concerns.

Compensation Details:

The City of Port Orange offers a competitive starting salary range of $96,000 - $115,000 depending upon qualifications and experience.
