Role Summary:
The Sr Counsel will work closely with the Electrify America management and business teams, providing legal support to technology, sales, and consumer-facing functions of Electrify America. This attorney will be responsible for consumer data privacy and protection; contract negotiation; and other regulatory as well as general business legal matters. This attorney will also be responsible for ongoing compliance with applicable court settlements and decrees.
Role Responsibilities:
Data Privacy (50%)
1. Oversee the company’s data privacy strategy, including implementation of CCPA and other applicable data privacy policies and procedures, readiness activities, and compliance.
2. Handle data privacy and protection-related inquiries from internal and external stakeholders and provide legal counsel regarding same.
3. Advise executives and business colleagues regarding the requirements of federal and state privacy and data security statutes and regulations, controls, and best practices (with a primary focus on CCPA, PCI-DSS, FTC Section 5, and TCPA in the United States; as well as PIPEDA, CASL, and other applicable laws in Canada).
4. Review and analyze new products and services, including online and mobile applications, for compliance with applicable privacy laws.
5. Draft, review, and negotiate data licenses, data privacy agreements, and contracts with significant data-sharing or management components.
6. Review, draft, and update policies and procedures which deal with data privacy, personal information, and data security.
7. Manage outside counsel regarding data privacy and security matters.
Contracts & Litigation (50%)
1. Draft, review, and negotiate contracts to support the technology, sales, and business activities of the company.
2. Assist business departments in contract compliance, interpretation, and dispute resolution.
3. Manage litigation, dispute resolution, and regulatory matters. Review and handle third-party complaints.
Years of Relevant Experience:
- 4-6 years law firm or in-house experience
Education:
- J.D. from leading law school

- Experience drafting and negotiating data licenses, data privacy agreements, contracts
Specialized Skills (Desired):
- Experience with Canadian data privacy law (including PIPEDA, CASL, and/or similar provincial regulations)
- Energy or Utility Industry experience
- Commercial transaction experience
- A strong business orientation or experience
- A passion for excellence in work product, and outstanding results for the business clients
- German language skills

Salary range is dependent on factors such as geographical differentials, industry-based experience, skills, training, credentials, and other qualifications.

In the state of Colorado, the salary range is $133,000 - $190,100.
In the state of Washington, the salary range is $133,000 - $190,100.
In New York City, the salary range is $159,600 - $228,100.
In Westchester County, the salary range is $159,600 - $228,100.
In the state of Rhode Island, the salary range is $133,000 - $190,100.
