A highly ranked and leading global pharmaceutical company located in New Jersey seeks an Associate Senior Counsel - Market Access to join their legal team. This position is hybrid in Essex County with a compensation package between $189K - $220K, plus bonus, LTI and a competitive benefits package.
Primary Duties:
The Associate Senior Counsel - Market Access will report to an Associate General Counsel and will serve as a strategic legal advisor to the company's commercial teams, with a focus on market access, customer contracting, trade relations, government price reporting, patient support programs, and broader pharmaceutical regulatory matters.. Additional responsibilities are as follows:
- Provide proactive legal counsel and day-to-day support on a broad range of market access and commercial matters.
- Draft and negotiate complex agreements with key stakeholders across the healthcare supply chain, including payors, PBMs, wholesalers, GPOs, distributors, and pharmacies.
- Advise on manufacturer-sponsored patient support programs, including co-pay assistance, coupons, reimbursement support, patient assistance programs, and adherence initiatives.
- Ensure compliance with all applicable pharmaceutical laws and regulations, including the Anti-Kickback Statute, False Claims Act, federal and state pricing laws, PhRMA Code, and FDA guidelines.
- Serve as legal representative on promotional review committees for market access materials.
- Monitor and communicate relevant legal and enforcement developments, such as DOJ and OIG guidance and industry trends, to internal stakeholders.
- Mitigate legal and reputational risks for assigned business clients by implementing sound legal strategies and policies.
- Develop and deliver legal training sessions related to compliance and industry best practices.
Requirements:
- Juris Doctor (JD) from an accredited law school.
- Active member in good standing of a U.S. state bar.
- Minimum seven years of legal experience, including at least four years advising the pharmaceutical or life sciences industry.
- Deep understanding of FDA regulations, fraud and abuse laws, and/or government price reporting requirements.
- Demonstrated ability to work in a fast-paced, cross-functional, and matrixed business environment.
- Excellent communication skills, with the ability to effectively convey legal guidance and collaborate with both legal and non-legal stakeholders.
