Job Summary:

The Department of Human Services (DHS) is seeking a dedicated Attorney II to provide legal expertise in supporting the department's mission of serving individuals with disabilities and aging populations. This role involves advising multiple divisions, ensuring regulatory compliance, and representing the department in legal proceedings.

Key Responsibilities:

  • Provide legal counsel to DHS divisions regarding disability, guardianship, and Medicaid-related matters.
  • Represent the department in administrative hearings and other legal proceedings.
  • Assist with guardianship and conservatorship cases.
  • Oversee compliance with federal and state regulations, including HIPAA and Medicaid waivers.
  • Manage open records requests and ensure adherence to public records laws.
  • Conduct legal research and draft memoranda, policies, and legal opinions.


Licenses and Certifications:

  • Juris Doctorate (JD) degree.
  • Licensed to practice law in South Dakota.


The Ideal Candidate Will Have:


  • 1-5 years of experience; knowledge of disability laws, guardianship laws, and Medicaid; and a strong desire to serve individuals with disabilities or who are aging.


Knowledge, Skills, & Abilities:

  • Strong legal research, writing, and analytical skills.
  • Ability to assess legal risks and provide clear, practical guidance.
  • Knowledge of intellectual and developmental disabilities law, guardianship law, and Medicaid regulations.
  • Ability to explain legal concepts clearly to non-legal professionals.
  • Experience handling administrative hearings and regulatory compliance matters is a plus.

This position is exempt from the Civil Service Act.
