Job Description

GENERAL SUMMARY OF DUTIES:  Responsible for the delivery and management of legal services and expert legal advice on a variety of topics including but not limited to employment and labor laws, litigation risks, contracts, and regulatory and compliance matters. 

SUPERVISION RECEIVED:  Reports directly to the Vice President – Legal Operations and Corporate Counsel

SUPERVISION EXERCISED:   N/A

ESSENTIAL FUNCTIONS:   

Employment

1. Support the head of Human Resources (HR) in providing employment and labor law advice and support

2. Oversee and manage outside counsel

3. Manage and review third-party subpoenas and requests for employee wage records

4. As appropriate, handle administrative agency charges and complaints by investigating and drafting responses

5. Perform internal investigations as necessary and document process for same

6. Support the HR team with a wide array of employment law issues, such as drafting separation agreements and other employment documents, advising on and developing policies or guidance including the associate handbook, complying with pay transparency and reporting obligations, advising on employment and labor relations issues, and projects such as internal audits/reviews

7. Assist HR team and business leaders with negotiating labor agreements

8. Keep abreast of changes in employment and labor laws and work with other members of the legal team, HR, and business leaders to implement policies and practices to ensure compliance

9. Work cooperatively with other members of the legal team to mitigate legal risk to the company

10. Identify and research legal issues that could impact the company and its activities

11. Keep abreast of OSHA/Safety changes, and reporting guidelines

12. Provide legal counsel and guidance on Workers Compensation program

13. Draft and administer vendor and other employment contracts.

Risk

14. Protect the interests of the Companies by managing risk, liability, and financial exposure.

15. Improve templates, playbooks, and policies and procedures to help scale with a consistent but locally relevant approach and to help the company to move quickly and thoughtfully

16. Recommend, develop, support, implement, and review company policies, procedures, and positions on legal and compliance issues

17. Risk management insurance claim administration

18. Investigate and evaluate the legal implications, impact of legal compliance issues, and recommend operational changes or alternative policies and procedures.

19. Receive and investigate inquiries from the Companies and their executives on matters including, but not limited to employment, contracts, insurance, risk management, licensing, and organization policy.

Litigation

20. Work closely with property management and litigation teams to resolve pre-litigation conflicts

21. Assist the legal team in managing all litigation filed against the Company, including coordination with and oversight of outside counsel and applicable insurance carriers

22. Oversee management and resolution of all insurance claims, facilitate investigations and coverage evaluations

23. Assist operations team in responding to tenant complaints and disputes

24. Provide legal counsel on issues arising from actual or anticipated lawsuits.

25. Provide guidance on Fair Housing issues and compliance.

Contracts

26. Draft and negotiate binding contractual agreements between the Company and third parties, as needed

27. Other duties as assigned

28. Assist with supporting cross-departments with contract questions

29. Perform other legal duties as assigned or as necessary.

PERFORMANCE REQUIREMENTS

 Knowledge of federal, state, and local employment laws.

 Strong interpersonal and communication skills.

 Strong writing skills.

 Strong legal research skills

 Licensed as an attorney qualified to practice law in the state of Colorado.

TYPICAL PHYSICAL DEMANDS:  Occasionally lifting items weighing up to 30 lbs.  Requires eye-hand coordination and manual dexterity sufficient to operate a keyboard, photocopier, telephone, calculator, and other office equipment.  Regular and consistent attendance on the job is an essential function. 

TYPICAL WORKING CONDITIONS:  Normal office environment. Possible evening or weekend work.

EDUCATION AND EXPERIENCE:

 Combination of the completion of a Bachelor's Degree and Juris Doctorate from an accredited law school and a minimum of two years' experience in corporate legal department or law firm is preferred.

 Background in risk management, insurance claim administration, employment law, and real estate preferred.

 Familiarity with fair housing laws is preferred.

 Familiarity with Human Resources employment practice and processes.

 Salary Range:
• $130,000 - $170,000/ Annualized 

  Bonus Potential:
• Eligible for 17% annual bonus potential, based on personal and company performance
