Job Description
Duties

Investigative Component
• Conduct confidential investigations of alleged corruption, fraud and misappropriation of public monies.
• Develop investigative case plans and strategies.
• Coordinate, prepare and conduct witness interviews.
• Conduct legal research and draft memorandums.
• Evaluate complaints received from the general public and other sources.
• Prepare written reports summarizing investigative findings.
• Draft subpoenas.
• Serve as liaison for the Office of the State Comptroller with federal, state and local law enforcement agencies.
• Collaborate with outside law enforcement to prepare an investigation for grand jury presentation or trial.
• Work closely with other divisions within the Office of the State Comptroller.
• Manage and prioritize active caseload and handle multiple projects simultaneously.
• Conduct discovery on criminal cases that are presented for prosecution within the State and Federal System.

• For appointment to the Assistant Attorney 1 you must have: Law school graduation and/or eligibility for the NYS Bar Admission.
• For appointment to the Assistant Attorney 2 you must have: Admission to the NYS Bar.
• For appointment to the Assistant Attorney 3 you must have: 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience.
• For appointment to the Senior Attorney, you must have: 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience.

Competitive Minimum Qualifications:
Position may be filled at the Senior Attorney level or one within the Legal Traineeship appointment levels. Appointment title will be dependent upon qualifications of candidate selected.
• Assistant Attorney 1 (Grade 18): Law school graduation and/or eligibility for NYS Bar Admission
• Assistant Attorney 2 (Grade 20): Admission to NYS Bar
• Assistant Attorney 3 (Grade 22): 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience
• Senior Attorney (Grade 25): 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience
For a 70.1 transfer to the Senior Attorney, SG-25, you must have one year of permanent competitive service in an approved 70.1 title allocated to a salary grade 23 or above.
For a 52.6 transfer to the Senior Attorney, SG-25, you must have one year of permanent competitive service in an approved 52.6 title allocated to a salary grade 23 or above and must have 12 months as an Assistant Attorney 3 OR admission to the New York State Bar AND 24 months of subsequent satisfactory legal experience.

55b/55c Program appointment:

Traineeship salary information:
The position may be filled at the Assistant Attorney 1 equated to SG-18 ($66,951), Assistant Attorney 2 equated to SG-20 ($74,193), Assnt Attorney 3 equated to (SG-22): $82,326or full performance Senior Attorney SG-25 ($96,336) based on the candidate’s education, experience, and previous state service. Salary is nonnegotiable.
Candidates hired at the trainee level will be advanced to the full performance Senior Attorney SG-25 following successful completion of the traineeship.

Other Information

Knowledge, skills, and abilities:

Graduate of an ABA-accredited law school and either admitted to practice law in New York State or scheduled to sit for the New York State bar exam.
• Minimum 1-2 years of criminal law experience.
• Knowledge of criminal law and procedure preferred.
• Knowledge of state and local government operations preferred.
• Strong computer skills and facility with various databases and research tools.
• Strong electronic research skills.
• Strong verbal and written communication skills.
• Must maintain high level of integrity, confidentiality and discretion.
• Strong work ethic, positive attitude and desire to function as part of a team.

Telecommuting: The Office of the New York State Comptroller (OSC) supports telecommuting where it is reasonable to do so based upon the agency’s mission and operational needs. Generally, employees new to OSC will be restricted from telecommuting for at least 8 calendar weeks. After the initial 8 calendar week restriction, if an employee’s primary residence location, duties, and work performance are aligned with telecommuting and operational needs they may be allowed to do so. Generally, OSC employees may telecommute up to 5 days per pay period but may be approved to telecommute less
