Job Description

The primary purpose of this position is to provide specialized professional legal support and services within the 502d Air Base Wing. The incumbent provides real property and environmental advice and litigation support to the Commander, 502d Air Base Wing, the Staff Judge Advocate, 502d Air Base Wing Office of the Staff Judge Advocate, and 502d Civil Engineering Squadron.

Duties Responsible for analyzing extremely complex and difficult issues to develop a course of action which anticipates future potential mission needs for a 20 to 40 year outlook, and ensures the solutions provided do not have unanticipated limitations on the mission. JBSA supports over 200 mission partners from all DoD components as well as Reserve and National Guard units. Utilizes extensive knowledge of United States Code provisions that pertain to acquisition, sale, lease, and divestiture of federal property. May be involved in issues which include but are not limited to, legislative jurisdiction, preemption, sovereign immunity, eminent domain, inverse condemnation, oil and gas leasing, and water rights. Performs extremely technical and complex legal research and provides oral and written opinions in all fields of Federal, State, and local environmental regulation. Issues may cover management of hazardous materials, including minimization of hazardous materials used in the maintenance of Department of Defense weapon systems, disposal of solid and hazardous waste, permitting of air emissions and water discharges, and assessment of environmental impacts of Federal actions, remediation of closed hazardous waste sites, and protection of sensitive, threatened, and endangered species. Prepares the litigation report, which sets forth the pertinent facts and a legal analysis of the case, and forwards to the appropriate division of the Department of Justice or the appropriate United States Attorney and, in most cases, becomes the basis for the position asserted by the United States. Researches, analyzes and evaluates complex issues and questions of real property and environmental law in the preparation of the litigation report, incumbent works directly with United States Attorney and Department of Justice officials in obtaining evidence and formulating strategy. Qualifications GENERAL REQUIREMENTS: You MUST have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD). In addition, at the time of application, you must provide proof, dated within four months of application, of "active" status with a bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. Specialized Experience: In addition to the basic requirement: you must have professional legal experience in excess of three (3) years that commensurate with the position's duties and responsibilities. KNOWLEDGE, SKILLS AND ABILITIES (KSAs): Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas: 1. Knowledge of federal, state and local environmental statutes, regulations, ordinances, and federal and state court decisions to perform extremely technical and complex legal research, strategic planning, and provide oral and written opinions in all fields of environmental issues. 2. Knowledge of real property law sufficient to research and resolve complex and difficult legal issues arising out of the management, use, acquisition, and disposal of real property, including natural and cultural resources, to develop legal opinions, and recommend the appropriate course of action. 3. Knowledge of the research resources commonly involved in environmental, occupational safety and health, natural and cultural resources, and real property laws; including various statutes, Department of Defense and Air Force policy and guidance, the United States Code, court opinions, the Code of Federal Regulations, etc; and familiarity with electronic research resources such as Westlaw, Lexis, etc. 4. Knowledge of federal civil procedure, environmental, natural and cultural, and real property law and knowledgeable in administrative, contracts, fiscal, and general law. Skill in advance planning and long range strategic thinking to identify and resolve actual or potential problem areas, trends, and/or similar factors which may limit JBSA, AF and DoD operations or future plans. 5. Skill in negotiation and rational and logical thinking in order to formulate, coordinate, and present the Air Force legal position before regulators, elected officials, the public, and senior officials for the Air Force and other relevant agencies. 6. Skill in written and oral advocacy in order to prepare and present written and oral briefings before decisionmakers, and make recommendations which are legally sufficient, and which maximize the options for JBSA, the Air Force, and DoD. PART-TIME OR UNPAID EXPERIENCE: Credit will be given for appropriate unpaid and or part-time work. You must clearly identify the duties and responsibilities in each position held and the total number of hours per week. VOLUNTEER WORK EXPERIENCE: Refers to paid and unpaid experience, including volunteer work done through National Service Programs (i.e., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community; student and social). Volunteer work helps build critical competencies, knowledge and skills that can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. ADDITIONAL CONDITIONS OF EMPLOYMENT: A Master of Laws (LL.M.) in environmental law or extensive environmental experience is required for successful completion of assigned duties. Professional knowledge of the law acquired through the study of law, as evidenced by having been conferred a Doctor of Law, is preferred. A comprehensive knowledge of laws, regulations, and policies impacting upon government real estate, litigation experience, environmental sustainment, and environmental compliance and planning and airspace and range law acquired through ten (10) years of work experience is desired. (An LL.M. in a related field can be substituted for five (5) of the (10) years). Education Must be a graduate of a law school accredited by the American Bar Association, and be currently licensed as an attorney, in active (or equivalent) status and in good standing, with the bar of a U.S. state, territory, or commonwealth. The attorney must maintain such bar membership in at least one jurisdiction during the entire course of employment with the Air Force.
