JOB TITLE: Commercial Attorney
REPORTS TO: Director, Commercial Services
JOB SUMMARY
Our Commercial Attorney is one who has a minimum of 10 years of industry related experience including 5 years of commercial related experience. H/She understands commercial escrow standards, title clearance, commitments to insure, title insurance policies with affirmative and/or extended coverages and endorsements, real estate regulations and guidelines, and legal and commercial loan document preparation and will conduct business development in coordination with the division Director.
DUTIES & RESPONSIBILITIES
- Conducts closings related to commercial transactions
- Drafts documents related to commercial transactions including purchase and sale agreements and asset purchase agreements and financing documentation
- Participate in negotiations related to commercial transactions
- Drafts and/or reviews settlement statements related to commercial transactions
- Review title searches, revise title commitments, prepare endorsement requests and approvals related to commercial transactions
- Handles title issues related to commercial transactions including clearance and underwriting questions
- Participates in establishing company title guidelines
- Assist in title review and underwriting for Company non-commercial transactions when requested
- Assist in training for Company in title and closing issues related to commercial transactions or otherwise as requested
- Become proficient in all Company software
- Perform other duties as assigned by supervisor
QUALIFICATIONS
EXPERIENCE
Minimum of 10 years of industry related experience including 5 years of commercial related experience.
EDUCATION
Juris Doctorate (JD) from an accredited law school
CERTIFICATIONS, LICENSES, INSURANCE
Applicable state licensure to practice law. Must be a notary public. Completion of the ALTA “Understanding Commercial Transactions” will be required prior to or withing 90 days of employment
KNOWLEDGE
An in depth understanding of commercial real estate title and settlement process.
