Job Description

The Assistant General Counsel prepares legal documents, provides advice on legal issues, and ensures compliance with the law to protect legal interests of the Road Commission. Reviews and prepares contracts for various departments related to software, construction, engineering services, cost participation agreements, and maintenance agreements. Negotiates and resolves contractual disputes between the Road Commission and other private and public entities. Manages all court orders, public notices, and subpoenas issued to the Road Commission. Supervises a Paralegal.


Duties: Under the direction of the General Counsel:

  • Reviews and prepares contracts for departments within the RCOC, including but not limited to contracts related to software, construction, engineering services, cost participation agreements, and maintenance agreements. Negotiates and resolves contractual disputes between the RCOC and other private and public entities.
  • Represents and provides legal advice and counsel to the RCOC board, directors, and staff to help achieve strategic goals and as to their legal rights and responsibilities acting on behalf of the RCOC, including but not limited to real property rights, pension related issues, employment, environmental, finance, and liability issues.
  • Manages road abandonment petitions submitted by the public. Conducts statutorily mandated public hearings as the hearing examiner and issues hearing examiner reports related to the road abandonment. Issues recommendation to the Board as to whether the abandonment should be approved or denied.
  • Manages Freedom of Information Act (“FOIA”) requests, court orders, public notices, subpoenas issued to the RCOC, and legal disputes between the RCOC and other entities or residents.
  • Determines interested parties and prepares statutorily required resolutions and declarations of taking for the Board’s review and approval.
  • Supervises, directs, and evaluates assigned staff. Supervisory functions include: has input on hiring and termination decisions; prioritizes assignments and directs work; develops and oversees employee work schedules; provides and/or facilitates employee training and development; approves/processes employee concerns and problems and counsels or disciplines as appropriate; completes employee performance appraisals.
  • Must perform duties in a safe, professional, and courteous manner to promote a positive image of the Road Commission for Oakland County. 
  • Requires a daily schedule that supports RCOC hours of operation.
  • Regular and predictable onsite job attendance is an essential function of this position.

 

Special Experience/Education:

  • A Juris Doctorate degree from an accredited law school.
  • Working knowledge of federal and state regulatory contract requirements.
  • State Bar of Michigan membership in good standing.
  • Minimum of five years work experience in litigation, real property law, county road laws and contracts.
  • Proficiency with information processing system databases (e.g. Lexis) and similar software.
  • Must possess and maintain a valid state of Michigan driver license.

  • Contract, municipal, county road, real property, tort employment and privacy laws.
  • Freedom of Information Act and other privacy laws.
