THE STARTING SALARY IS LIMITED TO $103,184. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the State of North Carolina in court and provides legal advice and representation to most state government departments, agencies, officers, and commissions. The Department also represents the State in criminal appeals from state trial courts and brings legal actions on behalf of the state and its citizens when the public interest is at stake.
This position assists the Department of Public Instruction (DPI), and other agencies as may be needed, with cases involving alleged work-related injuries to their employees. Some cases involve more complex factual and legal issues. Cases may involve multiple injuries, psychological injuries, extensive/unusual medical treatment, multiple issues, asbestosis claims, mold claims, serious occupational disease claims, death claims and post-traumatic stress disorder.
These cases necessitate extensive investigation, expert testimony, and detailed trial preparation. The issues potentially leave DPI exposed to liability for years of expensive medical treatment and wage loss, vocational rehabilitation and permanent injury resulting in enormous costs to the employer for extended periods of time.
This position also involves the added issue of the interplay between Episode of Violence, State Disability benefits and Workers’ Compensation. This attorney will handle medium to very complex workers’ compensation cases. This attorney will be housed with the Department of Justice and will be responsible for advising the DPI Risk Manager as necessary.
Other duties to include:
Researching and advising clients on risk management issues
Mentor to junior attorneys
Representing Employers on Lien Claims
Client education and outreach.
Representing the State in Criminal Appeals.

Knowledge, Skills and Abilities / Competencies
Management Preferences:
- Considerable knowledge of case, statutory, regulatory, common law, judicial and quasi-judicial procedures and the rules of evidence.
- Extensive knowledge of the Workers' Compensation Act, the N. C. Rules of Civil Procedure, the N.C. Rules of Evidence, the Rules of Professional Conduct, and any other related statue, regulation or code
- Knowledge of civil law & workers' compensation law
- Ability to interpret and apply constitutional provisions, statutes, administrative regulations, court decisions, other precedents, analyze facts, evidence, and legal documents.
- Skilled in legal research, analysis, writing, oral advocacy and litigation strategies
Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.
NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
Management prefers experience in workers’ compensation litigation or significant experience in civil litigation.
