Job Description
We are seeking a Plaintiff’s Personal Injury Attorney with experience in trucking and fleet vehicle litigation. The ideal candidate is a strategic litigator who understands the complexities of commercial vehicle cases, FMCSA regulations, and catastrophic injury claims. You will manage a caseload from intake through trial, working alongside a team of dedicated legal professionals
.
Key Responsibilities
- Handle all aspects of trucking and fleet vehicle personal injury cases, including pleadings, discovery, depositions, motion practice, mediations, and trial.
- Develop case strategies, conduct legal research, and draft high-quality legal documents.
- Engage in settlement negotiations and advocate zealously for clients.
- Work closely with experts, investigators, and medical professionals to build strong cases.
- Communicate with clients, keeping them informed and involved in their cases.
Qualifications
- Licensed Attorney in Texas and in good standing.
- 3+ years of experience in personal injury litigation, specifically in trucking and commercial vehicle cases.
- Strong understanding of:
- FMCSA regulations, DOT compliance, and Hours of Service (HOS) rules.
- Negligent entrustment, and commercial insurance policies.
- Intrastate vs. interstate trucking laws and jurisdictional issues.
- Respondeat superior, vicarious liability, and employer liability in commercial cases.
- Negligent hiring, training, supervision, and retention claims.
- Cargo liability, hazardous materials (HAZMAT) transport, and load securement requirements.
- Independent contractor vs. employee classification and FLSA implications.
- Insurance coverage issues, including MCS-90 filings, self-insured entities, and excess/umbrella coverage disputes.
- Negligence, liability, and personal injury law as applied to trucking and commercial vehicle accidents.
- Product liability and maintenance failures involving commercial vehicles.
- Trial experience preferred or a willingness to take cases to trial.
- Excellent writing, negotiation, and courtroom advocacy skills.
