THE STARTING SALARY FOR THIS POSITION IS LIMITED TO $87,849 - $103,184. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

Responsibilities:

The Motor Vehicles Section of the Attorney General’s Office provides comprehensive legal services to the Commissioner of the Division of Motor Vehicles, staff and directors and other Division employees.

The attorney in this position is a Motor Vehicle Unit expert and trial attorney in State and Federal law. This position is to provide the Division of Motor Vehicle’s with mature and experienced legal advice necessary for the proper and successful handling of complex, specialized and protracted litigation; and to assist the unit’s other attorneys in litigation assigned to them, as well as providing agency specific legal advice and counsel on any issues confronting the agency. The attorney in this position is assigned to defend and when necessary perfect appeals in civil suits against the DMV and its employees. DMV matters, especially contractual matters, have become highly complex and need a high degree of specialization for their successful completion and defense in litigation. To effectively represent the Division of Motor Vehicles and the State in lawsuits of this nature, the attorney in this position must have considerable expertise in interpreting and applying constitutional provisions, statutes, administrative regulations, court decisions and other precedents, and must have the ability to effectively work and communicate with adverse parties.

The attorney in this position provides legal advice to the Commissioner, the Deputy Commissioners, and the directors of the DMV on myriad topics related to their statutory duties and responsibilities, and is required to have a complete understanding of, and familiarity with, the state and federal statutes governing the DMV’s operations and the case law interpreting them. This attorney must be able to interpret constitutional provisions and state and federal statutes, administrative regulations, State and federal court decisions and other precedent and apply them to the DMV’s operations to determine whether changes should be made in its policies and practices to comply with law. This position may be asked to provide advice on all issues raised by the DMV, including, motor vehicle, criminal law, commercial law, bankruptcy law, wills and estates matters, taxation, the FLSA, disciplinary actions, and any related legislative initiatives.

The attorney in this position is regularly required to provide DMV officials written opinions interpreting statutes and court decisions and applying any such legal authority to the DMV’s practices and policies. The opinions provided by the attorney in this position are relied upon by the DMV to apply the statutes that it enforces, as well as to provide the basis for revisions to the DMV’s operating and training manuals.

The North Carolina Department of Justice, led by the Attorney General of North Carolina, represents the state, state agencies, and elected officials, and defends the rights of the people of North Carolina. The Department handles all state criminal appeals cases and assists district attorneys with complex criminal cases at their request. Additionally, the Department of Justice includes the North Carolina State Crime Lab, the North Carolina Justice Academy, and the Sheriffs’ and Criminal Justice Education and Training Standards Divisions.

Minimum Education and Experience Requirements

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience.

NOTE: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.

Management preferences: Experience in applying Chapter 20. Experience in representing DMV.

Applicants seeking National Guard Preference must attach a NGB 23A (RPAS) if you are a current member of the NC National Guard in good standing. If you are a former member of the NC National Guard who served for at least 6 years and was discharged under honorable conditions, you must attach either a DD256 or NGB 22.
