Job Description

This position is located in the Office of Professional Conduct, Actions and Litigation of the Federal Deposit Insurance Corporation in Washington, D.C. Salary reflects a pay cap for this position of $275,000.

Duties

  • Oversees attorneys providing legal advice and assistance to proposing and deciding officials on discipline, non-discipline, or other corrective actions arising from administrative investigations.
  • Manages the work of litigating attorneys representing the FDIC and practicing before administrative and judicial forums, including the Merit Systems Protection Board. Oversees the work performed by those attorneys, including litigation briefs, memoranda of law, pre-trial discovery, analysis of evidence and other legal activities and documents related to sensitive litigation issues, including those involving questions of first impression and with conflicting precedent that require extensive research, analysis and/or ingenuity to resolve.
  • Represents the FDIC in litigation efforts and/or provides oversight, review, and strategic direction for the negotiation of the highly complex agreements and settlements. Tracks, researches, and monitors decisions to ensure consistent application of adverse activity and highlights anomalies for additional review.
  • Advises and briefs the OPC leadership and the FDIC Board of Directors on highly complex and sensitive personnel, disciplinary, and litigation cases. Conducts presentations, briefings, case updates, and/or reports to leadership and/or the Board of Directors. Maintains lines of communication between the Office of General Counsel, Office of the Inspector General (OIG) and the OPC.
  • Collaborates on the development and implementation of OPC disciplinary, non-disciplinary, and litigation policies and procedures. Partners with other managers and executives in the OPC to ensure alignment of functions to guidance.
  • Participates in special assignments and efforts, including review of decisions, recommendations, internal policy, internal standard operating procedures, correspondence, and other work products, which result in the production and delivery of work products and services to the organizations.
  • Exercises supervisory personnel management authority directly or indirectly through subordinate senior managers to include: planning, assigning, and reviewing work products of subordinates; establishing guidelines and performance expectations; and, evaluating work performance and providing feedback. Identifies developmental and training needs of employees, provides and/or arranges for needed developmental training. Works in collaboration with the appropriate Human Resources and Legal staff to administer disciplinary action. Hears and resolves grievances or other disputes as appropriate. Approves/ disapproves requests for leave, telework, travel, training, etc. Ensures that programs are administered effectively and in accordance with broadly stated objectives and priorities.
  • Develops and communicates strategic plans and supports OPC mission, vision goals and objectives. Negotiates resources for continuous improvement of processes and programs. Identifies resources required the section, including advocating for staffing requirements and/or sourcing detail assistance from other divisions/offices. Justifies, executes, and tracks section budget activities; reviews and requests budget modifications in conjunction with the Deputy Director.

Ability to obtain and maintain a Top Secret security clearance.

Applicant tentatively selected for this position will be required to submit to urinalysis to screen for illegal drug use prior to appointment and will be subject to random drug tests.

Must be able to obtain and maintain an interim and/or final security clearance prior to entrance on duty. Failure to obtain and maintain the required level of security clearance may result in the withdrawal of a job offer or removal.

Employee may be relocated to any duty location to meet management needs.

Qualifications

To meet the minimum qualifications, applicants must possess the leadership and technical experiences listed below. These qualifications would typically be gained through serving in roles that require managing projects/teams or guiding the technical work of others.

Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic, religious/spiritual; community; student, social). Volunteer work helps build critical competencies, knowledge, skills, and abilities, and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

MINIMUM QUALIFICATIONS: All applicants must submit a resume that addresses each minimum qualification experience. Examples should be clear, and concise, and emphasize your level of responsibilities; the scope and complexity of the programs, activities, or services you managed; program accomplishments; policy initiatives undertaken; level of contacts; the sensitivity and criticality of the issues you addressed; and the results of your actions. You should use action-oriented leadership words to describe your experience and accomplishments and quantify your experience wherever possible to demonstrate your accomplishments (e.g., the number of employees supervised). Leadership experiences identified must have been performed in an official supervisory role.

Leadership Experience 1: Experience in overseeing and coordinating the work of organizational units, including assigning work; directing changes to programs and priorities; and evaluating performance against goals; AND
Leadership Experience 2: Experience setting performance expectations; assessing employee performance; providing recognition and rewards; providing feedback and development opportunities; addressing performance or conduct issues; and participating in recruitment and hiring activities; AND
Leadership Experience 3: Experience in leading teams of attorneys and/or independently assisting management with disciplinary actions arising out of highly sensitive and complex cases of employee misconduct, harassment, and/or retaliation.

Technical Experience 1: Experience in advising senior officials on highly sensitive and complex cases regarding employee misconduct, harassment, and/or retaliation; AND
Technical Experience 2: Experience in laws, regulations, principles, and precedents to oversee legal advice and litigation involving employee misconduct and discipline; AND
Technical Experience 3: Experience in solving complex and sensitive problems and issues, such as those involving apparently conflicting laws or other requirements and those involving vague and untested areas of case law, where policy decisions and case strategy guidance have impact throughout the organization.

Basic Qualification Requirement: License to practice before the highest court of a state, territory, commonwealth, or the District of Columbia and in good standing.
