ASSISTANT CITY PROSECUTOR

Department: City Attorney

Division: Legal

Pay Grade: GRADE 175: $94,256.66 - $136,672.15 Annual Salary

FLSA Status: Exempt, Non-Merit, Full-Time, Eligible for benefits.

GENERAL PURPOSE

This position prosecutes violations of criminal law and traffic regulations within Ogden City. Cases are filed in the Ogden City Justice Court. This position also handles de novo appeals with the Utah Second District Court. The assistant city prosecutor will receive direction from the city attorney and the city prosecutor.

ESSENTIAL JOB FUNCTIONS

  • Represent the City of Ogden in various criminal and traffic cases; research courtroom evidence; summon witnesses and negotiate pleas; attend morning video arraignments.
  • Prosecute civil remedies to enforce city ordinances, abate public nuisances, recover damages to city property, and condemn property for public purposes and other matters.
  • Review police reports and screen for possible cases with Police Officers; determine the number of offenses to be filed and develop case evidence.
  • Train and assist Police Officers with law enforcement issues.
  • Research legal questions and evaluate the impact on city policies and procedures.
  • Appear in court and administrative proceedings to represent the city's interests as required.
  • Coordinate office activities with those of other departments, outside agencies, and organizations; provide staff assistance to the City Attorney; prepare and present staff reports and other necessary correspondence.
  • Participate in safety and risk management activities; take action to reduce liability to the city.
  • Attendance and punctuality are essential functions of this position.
  • Employees must work as a team and frequently meet with co-workers and supervisors; employees must communicate in person with the public during office hours; and employees must use on-site equipment.
  • Participate on various boards and commissions; attend and participate in professional groups and committees.
  • Assist with various contract negotiations.
  • Respond to citizen complaints and research possible offenses.
  • Perform other related duties as required/assigned.

SPECIAL REQUIREMENTS

  • Membership in the State Bar of Utah.
  • Possession of, or ability to obtain, a valid Utah driver's license.
  • Submission of a personal writing sample at the time of application.
  • Employees must complete NIMS IS100 and IS700 within three months of hire.

EDUCATION AND EXPERIENCE REQUIREMENTS

  • One year of responsible experience in city or related government law, including trial experience.
  • Criminal trial experience is helpful but not necessary.
  • Equivalent to a Juris Doctorate from an accredited law school.
  • An equivalent combination of the above-stated work experience and education is acceptable.

KNOWLEDGE, SKILLS, AND ABILITIES

  • Knowledge of modern and highly complex principles and practices of public law.
  • Knowledge of the methods of public agency administration.
  • Knowledge of the organization, duties, powers, limitations, and authority of city government and the City Attorney's office.
  • Knowledge of the legal principles, practices, and procedures of civil, criminal, constitutional, and administrative law.
  • Knowledge of the methods and techniques of legal research.
  • Knowledge of and experience using electronic and paperless systems, i.e., efiling, ediscovery, Justiceware, or similar case management software systems.
  • Knowledge of established precedents and sources of legal reference applicable to city activities.
  • Skill in organizing, interpreting, and applying legal principles and knowledge of complex legal problems.
  • Skill in effectively applying legal knowledge and principles in court.
  • Skill in presenting statements of law, fact, and argument clearly and logically.
  • Skill in preparing and presenting difficult cases in court.
  • Skill in using technology, including word processing, Microsoft Office functions, and case management software.
  • Skill in typing at a speed necessary for in-court data entry in case management software.
  • Skill in researching complex legal problems and preparing sound legal opinions.
  • Skill in properly interpreting and making decisions in accordance with laws, regulations, and policies.
  • Skill in gaining cooperation through discussion and persuasion.
  • Ability to establish and maintain effective working relationships with those contacted during work.
  • Ability to maintain mental capacity, allowing effective interaction and communication with others.
  • Ability to comply with all city policies and regulations, including safety and risk management standards.

WORKING CONDITIONS & PHYSICAL REQUIREMENTS

  • The work environment is primarily in a courtroom, with moderate noise and temperature. Employees may be exposed to hostile conditions.
  • The work is sedentary work, which requires exerting up to 10 pounds of force occasionally and/or a negligible amount of force frequently or constantly to lift, carry, push, pull, or otherwise move objects, including the human body.
  • Must possess the physical ability to work primarily with fingers, perceive the nature of sounds, make rational decisions through sound logic and deductive processes, express or exchange ideas by the spoken word, substantial movements (motions) with the hands, wrists, and/or fingers, and discern letters or numbers at a given distance.
  • Additionally, the following physical abilities are required: grasping, handling, hearing, manual dexterity, mental acuity, reaching, repetitive motion, speaking, talking, visual acuity, and walking.
