Job Description

Summary
The Valley County Prosecuting Attorney’s Office is seeking an experienced criminal prosecutor to serve as Chief Deputy Criminal Prosecutor. This position serves as the lead criminal prosecutor primarily responsible for complex felony cases, and also acts on behalf of the elected Prosecuting Attorney in his or her absence.

The ideal candidate would bring extensive felony jury trial experience, a commitment to justice, and the integrity, determination, and skill required to manage challenging cases with confidence and compassion. The position primarily reviews cases referred to the Office by law enforcement agencies, determines if and what criminal charges will be filed, and handles all phases of prosecution both in and out of court.

Typical Responsibilities
The Chief Deputy Criminal Prosecutor for Valley County serves as the second-in-command for the elected Prosecuting Attorney when they're away, and leads the day-to-day operations of the criminal division. This includes mentoring other attorneys and support staff, and fostering a collaborative and professional work environment that encourages career growth.

This is a comprehensive role, primarily handling felony cases within the county from the initial stages through their conclusion. The incumbent in this position reviews police reports, determines charges, and drafts criminal complaints. They are expected to stay current on Idaho statutes and case law, using their knowledge and experience to advise and train law enforcement on case preparation and investigations, including assisting in obtaining search warrants. They also represent the county in court, managing various pre- and post-trial motions, as well as initiating proceedings for probation violations, bond revocations, and contempt petitions. Beyond criminal cases, they prosecute juvenile cases, child protection cases, and mental health commitments.

The incumbent works closely with the Victim/Witness Coordinator, helping to explain court proceedings to victims, preparing them and witnesses for court, and pursuing restitution on their behalf. In a leadership capacity, they review legal documents drafted by staff to ensure they comply with legal principles and court procedures.

Typical Qualifications
The ideal candidate will have a Juris Doctorate degree from an accredited law school and be licensed to practice law in Idaho as a member of the Idaho State Bar. The position requires at least five years of experience as an attorney practicing criminal law, including significant felony jury trial experience.

The individual must also possess a thorough working knowledge of constitutional law, criminal law, criminal procedures, rules of evidence, and prosecutorial ethics, along with a firm grasp of local judicial procedures and practices.

The candidate should be able to clearly articulate a case both in writing and orally, and have the ability to analyze, appraise, and organize facts, evidence, and legal precedent. Additionally, they must be able to appear in court and other judicial proceedings without assistance to present evidence, arguments, testimony, and witnesses before a judge or jury.
